                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for the closing of
     6     schools on certain holidays and for certain subsidiary
     7     payments and reimbursements.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 1502, act of March 10, 1949 (P.L.30,
    11  No.14), known as the "Public School Code of l949," amended
    12  January 24, 1966 (1965 P.L.1508, No.529), is amended to read:
    13     Section 1502.  Days Schools not to be Kept Open.--(a)  No
    14  school shall be kept open on any Saturday for the purpose of
    15  ordinary instruction, except when Monday is fixed by the board
    16  of school directors as the weekly holiday, or on Sunday,
    17  Memorial Day, Fourth of July, or Christmas nor shall any school
    18  be kept open in any district during the time of holding the
    19  teachers' institute for such district. Whenever Memorial day
    20  shall be on a Sunday, the following Monday shall be a holiday.

     1     (b)  Whenever a strike by school district employes
     2  necessitates the rescheduling of the calendar for the school
     3  year, no school shall be kept open on any day prohibited by
     4  subsection (a) or on any day the board has previously designated
     5  as an additional holiday for such school year pursuant to
     6  section 1503. No school district shall receive less subsidy
     7  payments or reimbursements for any school year solely because of
     8  lost instructional days caused by the prohibition on
     9  rescheduling instructional days on days designated as holidays.
    10     Section 2.  This act shall take effect commencing with the
    11  1980-1981 school year.
