AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, providing that the
3 Federal bankruptcy exemptions are not available to residents
4 of the Commonwealth.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 42, act of November 25, 1970 (P.L.707,
8 No.230), known as the Pennsylvania Consolidated Statutes, is
9 amended by adding a section to read:
10 § 8128. Nonavailability of Federal bankruptcy exemptions.
11 Residents of the Commonwealth of Pennsylvania shall not be
12 entitled to the Federal exemptions provided in section 522(d) of
13 the Bankruptcy Code of 1978 (11 U.S.C. 522(d)). Nothing herein
14 shall affect the exemptions given to residents of this
15 Commonwealth by any other statute of the Commonwealth.
16 Section 2. This act shall take effect immediately.
