                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prescribing the crime of theft of
     3     gasoline and providing penalties.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18, act of November 25, 1970 (P.L.707,
     7  No.230), known as the Pennsylvania Consolidated Statutes, is
     8  amended by adding a section to read:
     9  § 3933.  Theft of gasoline.
    10     (a)  Offense defined.--A person is guilty of theft of
    11  gasoline if he unlawfully takes, or exercises unlawful control
    12  over gasoline or other motor fuel of another with intent to
    13  deprive him thereof.
    14     (b)  Penalty.--Any person violating the provisions of this
    15  section shall, for a first offense, be guilty of a misdemeanor
    16  of the third degree and, at the discretion of the Secretary of
    17  Transportation, a three month suspension of driving privileges
    18  or application therefor; and for a second and subseguent offense

     1  shall be quilty of a misdemeanor of the first degree, and at the
     2  discretion of the Secretary of Transportation, a six month
     3  suspension of driving privileges or application therefor.
     4     Section 2.  This act shall take effect immediately.
