                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," authorizing townships to divide the areas of the
     5     township among fire companies for fire protection and
     6     organizational purposes.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Clause IV, of section 702, act of May 1, 1933
    10  (P.L.103, No.69), known as "The Second Class Township Code,"
    11  reenacted and amended July 10, 1947 (P.L.1481, No.567) and
    12  amended March 13, 1974 (P.L.192, No.36), is amended to read:
    13     Section 702.  Supervisors to Exercise Powers.--The corporate
    14  powers of townships of the second class shall be exercised by
    15  the township supervisors. Where no specific authority is given
    16  for the expenditures incident to the exercise of any power
    17  hereinafter conferred, or where no specific fund is designated
    18  from which such expenditures shall be made, appropriations for
    19  such expenditures shall be made only from the general township
    20  fund. In addition to the duties imposed upon them by section 516


     1  hereof, they shall have power--

     3     IV.  Fire Protection.--Out of the general township fund to
     4  purchase, or contribute to the purchase of, fire engines and
     5  fire apparatus, for the use of the township and to appropriate
     6  moneys to fire companies located therein for the operation and
     7  maintenance thereof, and for the purchase and maintenance of
     8  fire apparatus, and for the construction, repair and maintenance
     9  of fire company houses, in order to secure fire protection for
    10  the inhabitants of the township. An annual report of the
    11  expenditure of such appropriated moneys shall be made to the
    12  township supervisors for each completed fiscal year of the
    13  township by such fire companies, verified by an officer thereof,
    14  before any further payments shall be made to such fire companies
    15  out of appropriations for any current fiscal year. To ordain
    16  rules and regulations for the government of such fire companies
    17  and their officers, including a division of the township into
    18  fire protection areas, where the closest fire company by road
    19  miles will be the company designated to respond, and for other
    20  protection and organizational purposes. To enter into contracts
    21  with or to make grants to the proper authorities of near or
    22  adjacent cities, boroughs, or townships, or fire departments,
    23  fire companies, or fire company therein, for the furnishing to
    24  such townships of fire protection by the fire department, fire
    25  departments, fire companies, or fire company of such cities,
    26  boroughs, or townships, and to make appropriations therefor.
