           NOVEMBER 14, 1979

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," AUTHORIZING SCHOOL DISTRICTS TO OFFER  <--
     6     REWARDS FOR INFORMATION LEADING TO THE CONVICTION OF PERSONS
     7     VIOLATING THE CRIMES CODE ON SCHOOL PROPERTY, providing
     8     reimbursements for certain services for children affected
     9     with muscular dystrophy.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 1373.1 777, act of March 10, 1949          <--
    13  (P.L.30, No.14), known as the "Public School Code of 1949,"
    14  amended December 6, 1967 (P.L.699, No.325) AUGUST 24, 1977        <--
    15  (P.L.199, NO.59), is amended to read:
    16     SECTION 777.  DEFACING, INJURING OR DESTROYING PROPERTY USED   <--
    17  FOR SCHOOL PURPOSES; PENALTY.--(A)  IF ANY PERSON SHALL
    18  WILLFULLY OR MALICIOUSLY BREAK INTO, ENTER, DEFACE, OR WRITE,
    19  MARK, OR PLACE ANY OBSCENE OR IMPROPER MATTER UPON, ANY PUBLIC
    20  SCHOOL BUILDING, OR OTHER BUILDING USED FOR SCHOOL PURPOSES, OR
    21  OTHER PURPOSES PROVIDED FOR IN THIS ACT, OR ANY OUT-HOUSE USED


     1  IN CONNECTION THEREWITH; OR SHALL DEFACE, INJURE, DAMAGE, OR
     2  DESTROY ANY SCHOOL FURNITURE, BOOKS, PAPER, MAPS, CHARTS,
     3  APPARATUS, OR OTHER PROPERTY CONTAINED IN ANY PUBLIC SCHOOL
     4  BUILDING, OR OTHER BUILDING USED AND OCCUPIED FOR SCHOOL
     5  PURPOSES, OR OTHER PURPOSES PROVIDED FOR IN THIS ACT; OR SHALL
     6  INJURE, DAMAGE, OR DESTROY ANY SHADE-TREES, SHRUBBERY, FENCES,
     7  OR ANY OTHER PROPERTY OF ANY KIND, UPON ANY PUBLIC SCHOOL
     8  GROUNDS, OR UPON ANY PUBLIC SCHOOL PLAYGROUND, SUCH PERSON SHALL
     9  BE GUILTY OF A MISDEMEANOR, AND UPON CONVICTION THEREOF SHALL BE
    10  SENTENCED TO PAY A FINE OF NOT LESS THAN FIFTY DOLLARS ($50) AND
    11  NOT MORE THAN ONE THOUSAND DOLLARS ($1,000), OR UNDERGO AN
    12  IMPRISONMENT IN THE COUNTY JAIL FOR A PERIOD NOT EXCEEDING SIX
    13  MONTHS, EITHER OR BOTH, AT THE DISCRETION OF THE COURT. IN
    14  ADDITION TO ANY OTHER PENALTY PRESCRIBED BY THIS SUBSECTION, THE
    15  COURT, UPON CONVICTION OF A DEFENDANT FOR A VIOLATION OF THIS
    16  SUBSECTION, MAY ORDER THE DEFENDANT TO COMPENSATE THE SCHOOL
    17  DISTRICT FOR ANY DAMAGES IT SUSTAINED AS A RESULT OF THE
    18  DEFENDANT'S UNLAWFUL CONDUCT.
    19     (B)  THE BOARD OF SCHOOL DIRECTORS OF A SCHOOL DISTRICT IS
    20  AUTHORIZED TO ADOPT REGULATIONS AND PROCEDURES PROVIDING FOR
    21  REWARDS OF UP TO ONE THOUSAND DOLLARS ($1,000) TO ANY PERSON WHO
    22  PROVIDES INFORMATION WHICH AIDS IN THE CONVICTION OF ANY PERSON
    23  FOR VIOLATING THE PROVISIONS OF SUBSECTION (A) AND REWARDS OF UP
    24  TO FIVE THOUSAND DOLLARS ($5,000) TO ANY PERSON WHO PROVIDES
    25  INFORMATION WHICH AIDS IN THE CONVICTION OF ANY PERSON FOR
    26  VIOLATING ANY PROVISION OF TITLE L8 (CRIMES AND OFFENSES) OF THE
    27  PENNSYLVANIA CONSOLIDATED STATUTES, IF THE VIOLATION OCCURS ON
    28  SCHOOL PROPERTY OR PROPERTY UTILIZED FOR SCHOOL PURPOSES.
    29     SECTION 2.  SECTION 1373.1 OF THE ACT, AMENDED DECEMBER 6,
    30  1967 (P.L.699, NO.325), IS AMENDED TO READ:

     1     Section 1373.1.  Readers; Helpers; Guides; Aides; Appliances;
     2  Etc.; Reimbursement.--The Commonwealth shall reimburse school
     3  districts out of the moneys appropriated to the Department of
     4  [Public Instruction] Education for special education for the
     5  cost of readers, helpers, guides, aids, appliances, special
     6  school books and supplies and devices for any child between the
     7  ages of six and twenty-one years of age who is blind, partially
     8  sighted, deaf, hard of hearing, or afflicted with cerebral palsy
     9  or muscular dystrophy, and who is enrolled, with the approval of
    10  the Department of [Public Instruction] Education, in any of the
    11  public schools of the Commonwealth, an amount equal to the costs
    12  of these services and equipment multiplied by the district's aid
    13  ratio.
    14     No such expenditures nor purchases may be made by any school
    15  district unless in accordance with a budget submitted by the
    16  district and approved by the Department of [Public Instruction]
    17  Education. The total expenditure by the Commonwealth hereunder
    18  shall not exceed seventy-five percent of a sum which would have
    19  been expended for the tuition and maintenance of any such child
    20  in a residential school for the blind, including partially
    21  sighted, deaf, hard of hearing, or those afflicted with cerebral
    22  palsy, that has been approved by the Department of [Public
    23  Instruction] Education for the education of the blind, partially
    24  sighted, deaf, hard of hearing, or those afflicted with cerebral
    25  palsy or muscular dystrophy.
    26     The services of such readers, helpers and guides may be
    27  contracted and paid for by the school district irrespective of
    28  the age of the person rendering such assistance and of the
    29  employment of such person by the school district as a teacher or
    30  otherwise and of the time and place where such services are

     1  rendered.
     2     The Department of [Public Instruction] Education shall
     3  establish such necessary rules, regulations and standards as it
     4  may deem necessary for carrying out the provisions of this act.
     5     Section 2 3.  This act shall take effect in 60 days            <--
