AN ACT
1 Amending the act of December 1, 1965 (P.L.988, No.368),
2 entitled, as amended, "An act relating to weights and
3 measures; regulating the use and sale, and providing for the
4 inspection of weighing and measuring devices; regulating the
5 sale and packaging of commodities; imposing duties and
6 conferring powers upon the Attorney General and Department of
7 Justice and certain local officials; and prescribing
8 penalties," requiring a specific grant of power for the
9 bureau to adopt regulations relating to one-half gallon
10 pricing of motor fuels.
11 The General Assembly of the Commonwealth of Pennsylvania
12 hereby enacts as follows:
13 Section 1. Section 21, act of December 1, 1965 (P.L.988,
14 No.368), known as the "Weights and Measures Act of 1965," is
15 amended by adding a subsection to read:
16 Section 21. Method of Sale of Commodities.--* * *
17 (d) Notwithstanding any other provisions of law, the
18 Department of Agriculture through the Bureau of Standard Weights
19 and Measures shall not have any power to adopt any regulations
20 relating to the one-half gallon pricing of motor fuels without
21 first obtaining from the General Assembly through legislation
1 specific authority to adopt and implement a one-half gallon
2 pricing system for motor fuels.
3 Section 2. This act shall take effect immediately.
