                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," increasing
     4     amount of levy permitted for fire protection.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Clause (6) of section 1302, act of February 1,
     8  1966 (1965 P.L.1656, No.581), known as "The Borough Code,"
     9  amended July 16, 1975 (P.L.74, No.44), is amended to read:
    10     Section 1302.  Tax Levy.--The council of the borough shall
    11  have power, by ordinance, to levy and collect annually, a tax,
    12  not exceeding thirty mills for general borough purposes, unless
    13  the council by majority action shall, upon due cause shown by
    14  resolution, petition the court of common pleas, in which case
    15  the court may order a rate of not more than five mills
    16  additional to be levied and in addition thereto any of the
    17  following taxes:

    19     (6)  For the purchase of fire engines, fire apparatus and


     1  fire hose for the use of the borough, or for assisting any fire
     2  company in the borough in the purchase, renewal or repair of any
     3  of its fire engines, fire apparatus or fire hose, for the
     4  purposes of making appropriations to fire companies both within
     5  and without the borough and of contracting with adjacent
     6  municipalities or volunteer fire companies therein for fire
     7  protection, or for the purchase of land upon which to erect a
     8  fire house, or for the erection and maintenance of a fire house
     9  or fire houses, not exceeding [three] five mills. If an annual
    10  tax for the purposes specified in this clause is proposed to be
    11  set at a level higher than [three] five mills, the question
    12  shall be submitted to the voters of the borough, and the county
    13  board of elections shall frame the question in accordance with
    14  the election laws of the Commonwealth for submission to the
    15  voters of the borough;

    17     Section 2.  This act shall take effect in 60 days.
