A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect, providing for a basis for payments of such 6 appropriations and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby specifically appropriated to the 18 Trustees of the Pennsylvania State University for the fiscal 19 year July 1, 1979 to June 30, 1980, for the purposes and in the 20 amounts as shown:

11 Section 2. Payments to Pennsylvania State University on
12 account of the appropriations for all items as provided in
13 section 1 except for instruction - Doctor of Medicine shall be
14 made on the basis of costs during the fiscal year.
15 Payments for instruction - Doctor of Medicine shall be made
16 on the basis of full-time students enrollment at a rate not to
17 exceed $7,465 per student.
18 Section 3. If necessary, the Pennsylvania State University
19 may transfer funds among the appropriations listed in section 1,
20 clauses (1), (2), (3) (4) and (5): Provided, That the aggregate
21 amount transferred into or out of each appropriation during the
22 fiscal year shall not exceed 5% of the amount specifically
23 appropriated for that purpose.
24 Section 4. Payments to the Pennsylvania State University of
25 the appropriations herein provided shall be made monthly during
26 the fiscal year.
27 Such monthly payments shall be made in accordance with the
28 provisions of sections 2 and 3, on the basis of estimated costs
29 and full-time students enrolled in the Doctor of Medicine
30 program. The estimate of costs shall be submitted by the

1 Pennsylvania State University to the Secretary of Education, the 2 General Assembly and to the State Treasurer not later than 30 3 days prior to the date on which such payment is to be made. 4 Section 5. Notwithstanding any provision of the General 5 Appropriation Act of 1979 relating to the payment of retirement 6 expenses, the Trustees of the Pennsylvania State University 7 shall make all required payments to the State Employees' 8 Retirement Fund from the funds appropriated pursuant to this 9 act. 10 Section 6. The Pennsylvania State University shall apply the 11 moneys appropriated by this act only for such purposes as are 12 permitted in this act and shall at all times maintain proper 13 records showing the application of such moneys. Not later than 14 120 days after the close of the fiscal year to which this act 15 relates, the Pennsylvania State University shall file with the 16 Secretary of Education, the General Assembly, and with the 17 Auditor General of the Commonwealth, a statement setting forth 18 the amounts and purposes of all expenditures made from moneys 19 appropriated by this act and other university accounts during 20 said fiscal year, the number of full-time students enrolled in 21 the Doctor of Medicine program and costs, as provided in 22 sections 2 and 3, used as a basis for receipt of any 23 appropriation during said fiscal year. 24 Such statement of expenditures and number of full-time 25 students enrolled in the Doctor of Medicine program and costs 26 shall be reviewed by the Auditor General of the Commonwealth, 27 and he shall have the right, in respect to the moneys 28 appropriated by this act, to audit and disallow expenditures 29 made for purposes not permitted by this act and to cause such 30 sums to be recovered and paid by the Pennsylvania State 19790H1267B1607 - 3 -
1 University to the Treasurer of the Commonwealth. The Auditor 2 General shall also make a determination of full-time students 3 enrolled in the Doctor of Medicine program and costs and make a 4 certification as to their correctness. In respect to 5 expenditures made by the university from moneys other than those 6 appropriated by this act, the Auditor General shall have the 7 right to review only and he shall file annually with the General 8 Assembly such information concerning such expenditures as the 9 General Assembly or any of its committees may require. 10 Section 7. A report shall be submitted to the Governor and 11 the Appropriations and Education Committees of the Senate and 12 House of Representatives and shall include data for all programs 13 except the Doctor of Medicine program. Each such report, to be 14 submitted prior to October 1, 1980, shall cover the 12-month 15 period beginning September 1, 1979 and shall include for each 16 term during the period: 17 (1) The following counts and distributions: 18 (i) The definitions and numbers of faculty members employed 19 full-time, of faculty members employed part-time, of full-time 20 students enrolled in graduate courses, of full-time students 21 enrolled in undergraduate courses, of part-time students 22 enrolled in graduate courses, and of part-time students enrolled 23 in undergraduate courses. 24 (ii) A distribution of faculty members employed part-time by 25 the percentage of full-time employment. 26 (iii) Total numbers of undergraduate student credit hours, 27 divided into lower division and upper division course levels, 28 and of graduate student credit hours divided into three course 29 levels--master's, first professional and doctoral. 30 (iv) Number of different courses scheduled by level of 19790H1267B1607 - 4 -
1 instruction and the number of students receiving individual 2 instruction at each level of instruction. 3 (v) Number of terms scheduled and the dates thereof. 4 (2) Two classifications: one, a classification of faculty 5 members or other professional employees by title including: 6 professor, associate professor, assistant professor, instructor, 7 lecturer, research associate, librarian and academic 8 administrator; faculty members or other professional employees 9 under each title to be subdivided by type of assignment: 10 instructional or noninstructional divided into teaching and 11 nonteaching, and each such set of faculty members or other 12 professional employees to be further subdivided by type of 13 employment: full-time or part-time; and two, a classification of 14 faculty members and other professional employees by school and 15 department to be subdivided by type of assignment: instructional 16 or noninstructional divided into teaching and nonteaching, and 17 each such set of faculty members or other professional employees 18 to be further subdivided by type of employment: full-time or 19 part-time; and the following aggregates for each subdivision in 20 each classification: 21 (i) The number. 22 (ii) The sum of credits assigned to undergraduate classroom 23 courses and the sum of credits assigned to graduate classroom 24 courses taught, divided into lower division, upper division, 25 master's, first professional and doctoral course levels. 26 (iii) The sum of undergraduate classroom student credit 27 hours and the sum of graduate classroom student credit hours 28 generated; divided into lower division, upper division, 29 master's, first professional and doctoral course levels. 30 (iv) The sum of undergraduate individual instruction student 19790H1267B1607 - 5 -
1 credit hours and the sum of graduate individual instruction 2 student credit hours generated; divided into lower division, 3 upper division, master's, first professional and doctoral course 4 levels. 5 (v) Total salary paid. 6 (vi) Total salary paid from college or university funds. 7 (vii) Total salary paid from Federal funds. 8 (viii) Total salary paid from other funds. 9 (3) For each term of the period covered for each faculty 10 member employed full-time identified by school, department and 11 title: 12 An analysis of the average hours per week spent in college or 13 university-related activities, stating specifically hours spent 14 in undergraduate classroom contact and graduate classroom 15 contact, hours spent in preparation, hours spent in research and 16 hours spent in public service. 17 Section 8. In addition to the above requirements relative to 18 this appropriation, each report covering the 12-month period 19 beginning September 1, 1979, shall include for all programs of 20 the university: 21 (1) Minimum number of credits required for a baccalaureate 22 degree and for a master's degree. 23 (2) Number of bachelor's degrees, master's degrees, first 24 professional degrees, and doctoral degrees awarded in 1977, 25 1978, 1979 and estimated 1980. 26 The university shall report its revenues and expenditures and 27 present its financial statements required under the provisions 28 of this act in accordance with "Higher Education Finance Manual" 29 (1975). 30 SECTION 9. ALL INCREASES IN THIS APPROPRIATION IN EXCESS OF <-- 19790H1267B1607 - 6 -
1 A 5% INCREASE OVER THE PREVIOUS NONPREFERRED APPROPRIATION FOR 2 THIS INSTITUTION SHALL BE USED FOR MAINTAINING CURRENT STUDENT 3 TUITION COSTS, AND ONLY BE UTILIZED ON FUNDING CURRENT EXISTING 4 ACADEMIC PROGRAMS OR DIRECT STUDENT EDUCATIONAL RELATED COSTS. 5 THESE MONEYS MAY NOT BE USED TO FUND ANY INCREASE IN 6 ADMINISTRATIVE PERSONNEL, NEW PROGRAMS, OR NONACADEMIC 7 EXPENDITURES. THE ADMINISTRATION AND GOVERNING BODY OF THE 8 INSTITUTION SHALL PRODUCE THE FINANCIAL ACCOUNTING OF THESE 9 EXPENDITURES TO THE GENERAL ASSEMBLY BY JUNE 30, 1980 FOR THE 10 FIRST NINE MONTHS OF THE FISCAL YEAR JULY 1, 1979 TO JUNE 30, 11 1980. 12 Section 9 10. The university shall provide such information <-- 13 as may be necessary to carry out the provisions of this act and 14 in such form and manner as the Department of Education may 15 prescribe. 16 Section 10 11. The Pennsylvania State University shall <-- 17 report its revenues and expenditures and present its financial 18 statements required under the provisions of this act in 19 accordance with generally accepted accounting principles and 20 procedures for educational institutions as set forth in "Higher 21 Education Finance Manual" United States Department of Health, 22 Education and Welfare (1975) with the exceptions set forth in 23 the Commonwealth of Pennsylvania Budget Instructions for State 24 Related Universities, Phase I, Fiscal Year 1979-1980. Credits 25 granted for nontraditional programs such as CLEP, lifelong 26 learning etc., including all related costs and revenues thereof 27 shall be excluded from the function of "Instruction" and 28 included under "Public Service." 29 Section 11 12. In addition to the requirements of section 7, <-- 30 the Pennsylvania State University shall, by March 1, 1980, 19790H1267B1607 - 7 -
1 submit to the Appropriations and Education Committees of the
2 Senate and the House of Representatives a breakdown of the funds
3 budgeted for this fiscal year for the main campus and each
4 branch campus including expenditures budgeted from this act and
5 expenditures budgeted from moneys other than those appropriated
6 by this act.
7 Section 12 13. This act shall take effect July 1, 1979. <--
