A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect, providing for a basis for payments of such 6 appropriations and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby specifically appropriated to the 18 Trustees of the Pennsylvania State University for the fiscal 19 year July 1, 1979 to June 30, 1980, for the purposes and in the 20 amounts as shown: 21 (1) For educational and general expenses..... $87,673,000
1 (2) For cost of student aid.................. 1,760,000 2 (3) For cost of agricultural research........ 9,685,000 3 (4) For cost of agricultural extension 4 services................................. 8,196,000 5 (5) For cost of research..................... 8,138,000 6 (6) For cost of soil survey.................. 100,000 7 (7) For instruction - Doctor of Medicine 8 only..................................... 2,896,000 9 Section 2. Payments to Pennsylvania State University on 10 account of the appropriations for all items as provided in 11 section 1 except for instruction - Doctor of Medicine shall be 12 made on the basis of costs during the fiscal year. 13 Payments for instruction - Doctor of Medicine shall be made 14 on the basis of full-time students enrollment at a rate not to 15 exceed $7,465 per student. 16 Section 3. If necessary, the Pennsylvania State University 17 may transfer funds among the appropriations listed in section 1, 18 clauses (1), (2), (3) (4) and (5): Provided, That the aggregate 19 amount transferred into or out of each appropriation during the 20 fiscal year shall not exceed 5% of the amount specifically 21 appropriated for that purpose. 22 Section 4. Payments to the Pennsylvania State University of 23 the appropriations herein provided shall be made monthly during 24 the fiscal year. 25 Such monthly payments shall be made in accordance with the 26 provisions of sections 2 and 3, on the basis of estimated costs 27 and full-time students enrolled in the Doctor of Medicine 28 program. The estimate of costs shall be submitted by the 29 Pennsylvania State University to the Secretary of Education, the 30 General Assembly and to the State Treasurer not later than 30 19790H1267B1428 - 2 -
1 days prior to the date on which such payment is to be made. 2 Section 5. Notwithstanding any provision of the General 3 Appropriation Act of 1979 relating to the payment of retirement 4 expenses, the Trustees of the Pennsylvania State University 5 shall make all required payments to the State Employees' 6 Retirement Fund from the funds appropriated pursuant to this 7 act. 8 Section 6. The Pennsylvania State University shall apply the 9 moneys appropriated by this act only for such purposes as are 10 permitted in this act and shall at all times maintain proper 11 records showing the application of such moneys. Not later than 12 120 days after the close of the fiscal year to which this act 13 relates, the Pennsylvania State University shall file with the 14 Secretary of Education, the General Assembly, and with the 15 Auditor General of the Commonwealth, a statement setting forth 16 the amounts and purposes of all expenditures made from moneys 17 appropriated by this act and other university accounts during 18 said fiscal year, the number of full-time students enrolled in 19 the Doctor of Medicine program and costs, as provided in 20 sections 2 and 3, used as a basis for receipt of any 21 appropriation during said fiscal year. 22 Such statement of expenditures and number of full-time 23 students enrolled in the Doctor of Medicine program and costs 24 shall be reviewed by the Auditor General of the Commonwealth, 25 and he shall have the right, in respect to the moneys 26 appropriated by this act, to audit and disallow expenditures 27 made for purposes not permitted by this act and to cause such 28 sums to be recovered and paid by the Pennsylvania State 29 University to the Treasurer of the Commonwealth. The Auditor 30 General shall also make a determination of full-time students 19790H1267B1428 - 3 -
1 enrolled in the Doctor of Medicine program and costs and make a 2 certification as to their correctness. In respect to 3 expenditures made by the university from moneys other than those 4 appropriated by this act, the Auditor General shall have the 5 right to review only and he shall file annually with the General 6 Assembly such information concerning such expenditures as the 7 General Assembly or any of its committees may require. 8 Section 7. A report shall be submitted to the Governor and 9 the Appropriations and Education Committees of the Senate and 10 House of Representatives and shall include data for all programs 11 except the Doctor of Medicine program. Each such report, to be 12 submitted prior to October 1, 1980, shall cover the 12-month 13 period beginning September 1, 1979 and shall include for each 14 term during the period: 15 (1) The following counts and distributions: 16 (i) The definitions and numbers of faculty members employed 17 full-time, of faculty members employed part-time, of full-time 18 students enrolled in graduate courses, of full-time students 19 enrolled in undergraduate courses, of part-time students 20 enrolled in graduate courses, and of part-time students enrolled 21 in undergraduate courses. 22 (ii) A distribution of faculty members employed part-time by 23 the percentage of full-time employment. 24 (iii) Total numbers of undergraduate student credit hours, 25 divided into lower division and upper division course levels, 26 and of graduate student credit hours divided into three course 27 levels--master's, first professional and doctoral. 28 (iv) Number of different courses scheduled by level of 29 instruction and the number of students receiving individual 30 instruction at each level of instruction. 19790H1267B1428 - 4 -
1 (v) Number of terms scheduled and the dates thereof. 2 (2) Two classifications: one, a classification of faculty 3 members or other professional employees by title including: 4 professor, associate professor, assistant professor, instructor, 5 lecturer, research associate, librarian and academic 6 administrator; faculty members or other professional employees 7 under each title to be subdivided by type of assignment: 8 instructional or noninstructional divided into teaching and 9 nonteaching, and each such set of faculty members or other 10 professional employees to be further subdivided by type of 11 employment: full-time or part-time; and two, a classification of 12 faculty members and other professional employees by school and 13 department to be subdivided by type of assignment: instructional 14 or noninstructional divided into teaching and nonteaching, and 15 each such set of faculty members or other professional employees 16 to be further subdivided by type of employment: full-time or 17 part-time; and the following aggregates for each subdivision in 18 each classification: 19 (i) The number. 20 (ii) The sum of credits assigned to undergraduate classroom 21 courses and the sum of credits assigned to graduate classroom 22 courses taught, divided into lower division, upper division, 23 master's, first professional and doctoral course levels. 24 (iii) The sum of undergraduate classroom student credit 25 hours and the sum of graduate classroom student credit hours 26 generated; divided into lower division, upper division, 27 master's, first professional and doctoral course levels. 28 (iv) The sum of undergraduate individual instruction student 29 credit hours and the sum of graduate individual instruction 30 student credit hours generated; divided into lower division, 19790H1267B1428 - 5 -
1 upper division, master's, first professional and doctoral course 2 levels. 3 (v) Total salary paid. 4 (vi) Total salary paid from college or university funds. 5 (vii) Total salary paid from Federal funds. 6 (viii) Total salary paid from other funds. 7 (3) For each term of the period covered for each faculty 8 member employed full-time identified by school, department and 9 title: 10 An analysis of the average hours per week spent in college or 11 university-related activities, stating specifically hours spent 12 in undergraduate classroom contact and graduate classroom 13 contact, hours spent in preparation, hours spent in research and 14 hours spent in public service. 15 Section 8. In addition to the above requirements relative to 16 this appropriation, each report covering the 12-month period 17 beginning September 1, 1979, shall include for all programs of 18 the university: 19 (1) Minimum number of credits required for a baccalaureate 20 degree and for a master's degree. 21 (2) Number of bachelor's degrees, master's degrees, first 22 professional degrees, and doctoral degrees awarded in 1977, 23 1978, 1979 and estimated 1980. 24 The university shall report its revenues and expenditures and 25 present its financial statements required under the provisions 26 of this act in accordance with "Higher Education Finance Manual" 27 (1975). 28 Section 9. The university shall provide such information as 29 may be necessary to carry out the provisions of this act and in 30 such form and manner as the Department of Education may 19790H1267B1428 - 6 -
1 prescribe. 2 Section 10. The Pennsylvania State University shall report 3 its revenues and expenditures and present its financial 4 statements required under the provisions of this act in 5 accordance with generally accepted accounting principles and 6 procedures for educational institutions as set forth in "Higher 7 Education Finance Manual" United States Department of Health, 8 Education and Welfare (1975) with the exceptions set forth in 9 the Commonwealth of Pennsylvania Budget Instructions for State 10 Related Universities, Phase I, Fiscal Year 1979-1980. Credits 11 granted for nontraditional programs such as CLEP, lifelong 12 learning etc., including all related costs and revenues thereof 13 shall be excluded from the function of "Instruction" and 14 included under "Public Service." 15 Section 11. In addition to the requirements of section 7, 16 the Pennsylvania State University shall, by March 1, 1980, 17 submit to the Appropriations and Education Committees of the 18 Senate and the House of Representatives a breakdown of the funds 19 budgeted for this fiscal year for the main campus and each 20 branch campus including expenditures budgeted from this act and 21 expenditures budgeted from moneys other than those appropriated 22 by this act. 23 Section 12.
