AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," adding provisions relating 4 to personal care boarding homes. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. As much of section 901 as relates to "institution 8 for adults," act of June 13, 1967 (P.L.31, No.21), known as the 9 "Public Welfare Code," is amended, and the section is amended by 10 adding a definition to read: 11 Section 901. Definitions.--As used in this article-- 12 * * * 13 "Institution for adults" means any incorporated or 14 unincorporated public or private organization, society or 15 association including any agency of a county, county institution 16 district or municipality which provides for food, shelter and 17 some service to adults, or which provides rehabilitation, 18 training, guidance or counselling to the blind or visually
1 handicapped, or to the physically or mentally handicapped, 2 including but limited to the following: homes for the aged and 3 infirm, nursing homes, convalescent homes, placement agencies 4 for adults, general and special hospitals and institutions for 5 mentally ill and defective adults, rehabilitation centers having 6 living-in arrangements, workshops and facilities for the 7 rehabilitation of the visually, mentally or physically 8 handicapped, [and] all organizations for the prevention of 9 blindness and all personal care boarding homes. 10 * * * 11 "Personal care boarding home" means any facility, home, 12 lodging or institution, however named, operated for profit or 13 otherwise, which accommodates five or more individuals unrelated 14 to the owner or manager who require, on a continuing basis, in 15 addition to room and board, a minimal level of personal care, 16 supervision or assistance in daily routine activities such as 17 bathing, dressing, diet or the taking of medication prescribed 18 for self-administration or who may also require assistance in 19 the financial management of his personal affairs. 20 * * * 21 Section 2. Section 1001 is amended by adding a definition 22 and section 1006 of the act is amended to read: 23 Section 1001. Definitions.--As used in this article-- 24 * * * 25 "Personal care boarding home" means any facility, home, 26 lodging or institution, however named, operated for profit or 27 otherwise, which accommodates five or more individuals unrelated 28 to the owner or manager who require, on a continuing basis, in 29 addition to room and board, a minimal level of personal care, 30 supervision or assistance in daily routine activities such as 19790H1227B1384 - 2 -
1 bathing, dressing, diet or the taking of medication prescribed 2 for self-administration or who may also require assistance in 3 the financial management of his personal affairs. 4 * * * 5 Section 1006. Fees.--Annual licenses shall be issued when 6 the proper fee, if required, is received by the department and 7 all the other conditions prescribed by this act are met. The 8 fees shall be: 9 Facility Annual License Fee 10 Adult day care center $ 15 11 Mental health establishment 50 12 Personal care home 10 13 Hospital 100 14 Nursing home--under 30 beds 15 15 --over 30 but under 50 beds 25 16 --50 but under 100 beds 50 17 --100 or more beds 75 18 Maternity home 15 19 Personal care boarding home 15 20 No fee shall be required for the annual license in the case 21 of day care centers, family day care homes, boarding homes for 22 children or for public or nonprofit mental institutions. 23 Section 3.
