AN ACT 1 Authorizing and directing the Department of General Services, 2 with the approval of the Department of Environmental 3 Resources and the Governor, to grant and convey an easement 4 and right-of-way to the Belle Coal Company, concerning 5 certain riverbed land in Greene County, Pennsylvania. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The Department of General Services, with the 9 approval of the Department of Environmental Resources and the 10 Governor, is hereby authorized and directed, on behalf of the <-- 11 Commonwealth of Pennsylvania, to grant and convey, FOR SUCH <-- 12 CONSIDERATION AS DETERMINED BY AN INDEPENDENT APPRAISAL OBTAINED 13 BY THE DEPARTMENT OF GENERAL SERVICES, an easement and right-of- 14 way for a barge mooring and loading facility to the Belle Coal 15 Company, in the following described tract of land situate in 16 Jefferson Township, Greene County, Pennsylvania, bounded and <-- 17 described as follows: 18 Beginning at a point along the west bank of the Monongahela 19 River 3,168 feet north of Mile 67 (1,000 feet north of the
1 northernmost Gateway Mooning Pier), this point being 46 feet 2 riverward (east) of the normal pools shoreline (elevation 3 763.0); then north, parallel to the normal pool line 175 feet to 4 a point; then west 46 feet to the normal pool shoreline 5 (elevation 763.0); then south along the normal pool line 175 6 feet; then east 46 feet to the normal pool line to the place of 7 beginning; containing 8,050 square feet, more or less. This 8 tract of river bottom land is adjacent to 110.717 acres of land 9 owned by the Hillman Coal and Coke Company. The Hillman Coal and 10 Coke Company owns in fee simple the 110.717 acres which borders 11 along the ordinary high water line which parallels the ordinary 12 low water shoreline, which in this pool, (the Maxwell pool) is 13 the same as the normal pool shoreline, elevation 763.0 feet. 14 This 110.717 acre tract of land is recorded in the Recorder of 15 Deeds Office in and for Greene County at Deed Book Vol. No.470, 16 Page 553. Hillman Coal and Coke Company also owns in fee simple 17 the land located between the ordinary high water mark (766.4) 18 and the ordinary low water mark (763.0). 19 An accurate surveyed description of the land concerning the 20 easement shall be prepared by Belle Coal and shall be 21 transmitted to the Department of General Services if requested 22 by the Department of General Services. 23 SECTION 2. THE COST OF THE INDEPENDENT APPRAISAL SHALL BE <-- 24 BORNE BY THE PROPOSED GRANTEE. 25 Section 2. 3. The conveyance of the easement and right-of- <-- 26 way shall be approved by the Department of Justice and shall be 27 executed by the Secretary of General Services in the name of the 28 Commonwealth. 29 Section 3. 4.
