        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JUNE 19, 1979

                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the DEPARTMENT OF ENVIRONMENTAL           <--
     3     RESOURCES AND THE Governor, to grant and convey an easement
     4     and right-of-way to the Belle Coal Company, concerning
     5     certain riverbed land in Greene County, Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the DEPARTMENT OF ENVIRONMENTAL RESOURCES AND THE     <--
    10  Governor, is hereby authorized and directed on behalf of the
    11  Commonwealth of Pennsylvania, to grant and convey an easement
    12  and right-of-way FOR A BARGE MOORING AND LOADING FACILITY to the  <--
    13  Belle Coal Company, in the following described tract of land
    14  situate in Jefferson Township, Greene County, Pennsylvania
    15  bounded and described as follows:
    16     Beginning at a point along the west bank of the Monongahela
    17  River 3,168 feet north of Mile 67 (1,000 feet north of the
    18  northernmost Gateway Mooning Pier), this point being 46 feet
    19  riverward (east) of the normal pools shoreline (elevation


     1  763.0); then north, parallel to the normal pool line 175 feet to
     2  a point; then west 46 feet to the normal pool shoreline
     3  (elevation 763.0); then south along the normal pool line 175
     4  feet; then east 46 feet to the normal pool line to the place of
     5  beginning; containing 8,050 square feet, more or less. This
     6  tract of river bottom land is adjacent to 110.717 acres of land
     7  owned by the Hillman Coal and Coke Company. The Hillman Coal and
     8  Coke Company owns in fee simple the 110.717 acres which borders
     9  along the ordinary high water line which parallels the ordinary
    10  low water shoreline, which in this pool, (the Maxwell pool) is
    11  the same as the normal pool shoreline, elevation 763.0 feet.
    12  This 110.717 acre tract of land is recorded in the Recorder of
    13  Deeds Office in and for Greene County at Deed Book Vol. No.470,
    14  Page 553. Hillman Coal and Coke Company also owns in fee simple
    15  the land located between the ordinary high water mark (766.4)
    16  and the ordinary low water mark (763.0).
    17     An accurate surveyed description of the land concerning the
    18  easement shall be prepared by Belle Coal and shall be
    19  transmitted to the Department of General Services if requested
    20  by the Department of General Services.
    21     Section 2.  The conveyance of the easement and right-of-way
    22  shall be approved by the Department of Justice and shall be
    23  executed by the Secretary of General Services in the name of the
    24  Commonwealth.
    25     Section 3.  This act shall take effect immediately.
