                                     AN ACT

     1  Requiring the sale by the Department of Transportation of
     2     property interests acquired for certain highway projects in
     3     Philadelphia County.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Upon the effective date of this act, the
     7  Department of Transportation shall offer for sale, at the
     8  department's acquisition price, certain property interests
     9  acquired in connection with the Pulaski-Roosevelt Boulevard
    10  interchange in Philadelphia County as follows:
    11         (1)  4700 block Roosevelt Boulevard;
    12         (2)  800 block Foulkrod Street;
    13         (3)  800 block Bridge Street; and
    14         (4)  800 block Granite Street.
    15     Section 2.  The department shall offer the easement or fee
    16  simple title acquired to the present tenant at the acquisition
    17  price. The tenant shall have this right of first refusal, and
    18  shall notify the department within 60 days whether he accepts or
    19  rejects the offer.

     1     Section 3.  If the present tenant rejects the offer, then the
     2  department shall make the same offer to the owner from whom the
     3  department acquired the property. The owner shall have this
     4  right of second refusal, and shall notify the department within
     5  60 days whether he accepts or rejects the offer.
     6     Section 4.  If both the tenant and owner reject the offer,
     7  the department shall then proceed immediately with the necessary
     8  arrangements for a public sale to the highest bidder.
     9     Section 5.  The Department of Transportation shall be liable
    10  to the City of Philadelphia for any real estate taxes that might
    11  be due during the period the department owned such property
    12  pursuant to the eminent domain proceedings. The department shall
    13  also reimburse any owner the amount of real estate taxes that he
    14  has paid on the property from the time of the declaration of
    15  taking.
    16     Section 6.  This act shall take effect in 60 days.
