        AS RE-REPORTED FROM COMMITTEE ON APPROPRIATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, OCTOBER 15, 1979

                                     AN ACT

     1  Amending the act of February 1, 1966 (1965 P.L.1656, No.581),
     2     entitled "An act concerning boroughs, and revising, amending
     3     and consolidating the law relating to boroughs," providing     <--
     4     for AUTHORIZING CERTAIN BOROUGHS TO OPERATE cable television   <--
     5     service to FOR borough inhabitants.                            <--

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 2471, act of February 1, 1966 (1965
     9  P.L.1656, No.581), known as "The Borough Code," is amended to
    10  read:
    11     Section 2471.  Manufacture and Purchase of Electricity.--Any
    12  borough may manufacture or purchase electricity for the use of
    13  the inhabitants of such borough. Any borough owning or operating
    14  electric light plants may make contracts for supplying
    15  electricity for commercial purposes outside the limits of such
    16  borough, with the consent of the municipal and township
    17  authorities. Nothing in this section shall conflict with the
    18  corporate rights of any corporation empowered to supply
    19  electricity in territory adjacent to such boroughs, or with the

     1  rights of any other borough. No person, firm, or corporation
     2  shall introduce electric current for light, heat, or power
     3  purposes, without the consent of the borough authorities, into
     4  the limits of any borough which is furnishing electric current
     5  to the inhabitants: Provided, however, That this section shall
     6  not apply to any person, firm, or corporation manufacturing
     7  electricity exclusively for its own use: And provided further,
     8  That before any borough shall construct an electric light plant,
     9  or purchase the property of any person, copartnership, or
    10  electric light company, the question of the increase of the debt
    11  of such borough, for any of such purposes, shall first be
    12  submitted to the qualified voters of the borough, in the manner
    13  provided by law for the increase of indebtedness of municipal
    14  corporations. Any borough which purchases electricity for the     <--
    15  use of the inhabitants of the borough may also own, operate and
    16  provide cable television service to the borough inhabitants.
    17  NOTHING IN THIS ACT SHALL BE CONSTRUED SO AS TO DISALLOW ANY      <--
    18  BOROUGH OPERATING A CABLE TELEVISION SYSTEM AS OF JULY 1, 1979
    19  FROM CONTINUING TO OPERATE THE SAME.
    20     Section 2.  This act shall take effect in 60 days.
