AN ACT
1 Amending the act of June 5, 1968 (P.L.140, No.78), entitled "An
2 act regulating the writing, cancellation of or refusal to
3 renew policies of automobile insurance; and imposing powers
4 and duties on the Insurance Commissioner therefor," requiring
5 insurers to restore or replace in kind automobiles damaged in
6 accidents, and making editorial changes.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The title, act of June 5, 1968 (P.L.140, No.78),
10 entitled "An act regulating the writing, cancellation of or
11 refusal to renew policies of automobile insurance; and imposing
12 powers and duties on the Insurance Commissioner therefor," is
13 amended to read:
14 AN ACT
15 Regulating the writing, cancellation of or refusal to renew
16 policies of automobile insurance; providing for the terms of
17 policies; and imposing powers and duties on the Insurance
18 Commissioner [therefor].
19 Section 2. The act is amended by adding a section to read:
20 Section 4.2. Any policy of automobile insurance shall
1 provide for the payment to the insured, in the event of damage
2 to the vehicle, of an amount sufficient to restore the vehicle
3 to its condition prior to the damage, or to replace the vehicle
4 in kind.
5 Section 2. This act shall take effect in 60 days and shall
6 apply to policies of automobile insurance written or renewed on
7 and after that date.
