A SUPPLEMENT 1 To the act of September 28, 1978 (P.L.787, No.151), entitled "An 2 act providing for the capital budget for the fiscal year 3 1978-1979," itemizing transportation assistance projects to 4 be acquired or constructed by the Pennsylvania Transportation 5 Assistance Authority together with their estimated financial 6 cost; itemizing transportation assistance projects to be 7 acquired or purchased by the Pennsylvania Department of 8 Transportation; authorizing the incurring of debt without the 9 approval of the electors for the purpose of financing the 10 projects, stating the estimated useful life of certain of the 11 projects, and making an appropriation. 12 The General Assembly of the Commonwealth of Pennsylvania 13 hereby enacts as follows: 14 Section 1. Itemization and Authorization of Urban Common 15 Carrier Transportation Assistance Projects.--Additional capital 16 projects in the category of transportation assistance projects 17 with respect to which an interest is to be acquired in or 18 constructed by the Pennsylvania Transportation Assistance 19 Authority, its successors or assigns, and to be financed by the 20 incurring of debt, are hereby itemized, together with their 21 respective estimated financial costs and the total additional 22 amount authorized for transportation assistance projects, as

Allocation of Funds.--Whenever as determined by 19790H0643B1504 - 6 -
1 the Pennsylvania Transportation Assistance Authority, the full 2 estimated financial costs of any of the transportation 3 assistance projects itemized in section 1 above is not necessary 4 for the proper design, acquisition of an interest in or 5 construction of such project, the excess funds no longer 6 required may be allocated by the Pennsylvania Transportation 7 Assistance Authority to increase the estimated cost of any one 8 or more of the transportation assistance projects specifically 9 itemized in a capital budget. 10 Section 3. Estimated Useful Life of Projects.--The General 11 Assembly states that the estimated useful life of urban common 12 carrier transportation assistance projects above itemized in the 13 capital budget for fiscal years 1978-1979 is not less than 30 14 years from the date of completion or acquisition of rights-of- 15 way, track, roadbeds, tunnels, electrification systems, 16 structures, airport improvements, buildings, stations, lands and 17 interests therein and the like; is not less than 15 years from 18 the date of acquisition of rolling stock; and is not less than 19 12 years from the date of acquisition of passenger buses. The 20 term of the debt authorized to be incurred hereunder shall not 21 exceed 30 years from the date of the first acquisition or 22 completion. 23 Section 4. Itemization and Authorization of Rural and 24 Intercity Transportation Assistance Projects.--Additional 25 capital projects and rail acquisition projects to be undertaken 26 by the Department of Transportation, pursuant to the provisions 27 of the act of February 11, 1976 (P.L.14, No.10), known as the 28 "Pennsylvania Rural and Intercity Common Carrier Surface 29 Transportation Assistance Act," and to be financed by the 30 incurring of debt, are hereby itemized, together with their 19790H0643B1504 - 7 -

Allocation of Funds.--Whenever as determined by 3 the Department of Transportation, the full estimated financial 4 costs of any transportation assistance or acquisition projects 5 itemized in section 4 above is not necessary for the proper 6 design, acquisition of an interest in or construction of such 7 project, the excess funds no longer required may be allocated by 8 the Department of Transportation to increase the estimated cost 9 of any one or more of the transportation assistance or 10 acquisition projects specifically itemized in a capital budget. 11 Section 6. Debt Authorization.--The Governor, Auditor 12 General and State Treasurer are hereby authorized and directed 13 to borrow, from time to time, in addition to any authorization 14 heretofore or hereafter enacted, on the credit of the 15 Commonwealth, subject to the limitations provided in the current 16 capital budget, money not exceeding in the aggregate the sum of 17 $71,284,000 as may be found necessary to carry out the 18 acquisition and construction of the transportation assistance 19 projects specifically itemized in a capital budget. 20 Section 7. Issue of Bonds.--The indebtedness herein 21 authorized shall be incurred from time to time and shall be 22 evidenced by one or more series of general obligation bonds of 23 the Commonwealth in such aggregate principal amount for each 24 series as the Governor, Auditor General and State Treasurer 25 shall determine, but the latest stated maturity date shall not 26 exceed 30 years from the date of the bond first issued for each 27 such series. 28 Section 8. Appropriation.--The net proceeds of the sale of 29 the obligations herein authorized are hereby appropriated from 30 the Capital Facilities Fund to the Pennsylvania Transportation 19790H0643B1504 - 13 -
1 Assistance Authority in the maximum amount of $69,950,000, and 2 to the Department of Transportation in the maximum amount of 3 $1,334,000, to be used by it exclusively to defray the costs of 4 transportation assistance and acquisition projects specifically 5 itemized in a capital budget. After reserving or paying the 6 expenses of the sale of the obligation, the State Treasurer 7 shall pay out to the Pennsylvania Transportation Assistance 8 Authority and the Department of Transportation the moneys as 9 required and certified by it to be legally due and payable. 10 Section 9. Federal Funds.--In addition to those funds herein 11 appropriated, all moneys received from the Federal Government 12 for the acquisition or construction of the public improvement 13 projects specifically itemized herein are also hereby 14 appropriated for those projects. 15 Section 10. Repeal.--The act of September 28, 1978 (P.L.811, 16 No.159) entitled "A supplement to the act of September 28, 1978 17 (P.L.787, No.151), entitled 'An act providing for the capital 18 budget for the fiscal year 1978-1979,' itemizing transportation 19 assistance projects to be acquired or constructed by the 20 Pennsylvania Transportation Assistance Authority together with 21 their estimated financial cost; authorizing the incurring of 22 debt without the approval of the electors for the purpose of 23 financing the projects, stating the estimated useful life of the 24 projects, and making an appropriation," is hereby repealed. 25 Section 11.
