                                     AN ACT

     1  Prohibiting pension benefits to certain officials.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Definitions.
     5     The following words and phrases when used in this act shall
     6  have, unless the context clearly indicates otherwise, the
     7  meanings given to them in this section.
     8     "Local official."  Any person elected or appointed to any
     9  office of any political subdivision.
    10     "Pension benefits."  Any annuity or payment which any local
    11  official would receive upon retirement as provided for in the
    12  appropriation act of the General Assembly.
    13  Section 2.  Conviction and prohibition of benefits.
    14     Any local official who is convicted of any felony involving
    15  misbehavior in office shall not receive any pension benefits but
    16  shall be entitled to receive only his salary contributions
    17  together with any statutory interest thereon. As used in this


     1  section, conviction means initial conviction by a court of
     2  record and includes pleas of guilty and nolo contendere. If on
     3  appeal the conviction is reversed and the member is ultimately
     4  acquitted, his pension benefits will be retroactively restored
     5  as heretofore existing at the time of termination of service.
     6  Section 3.  Effective date.
     7     This act shall take effect immediately.
