                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for eligibility to
     6     the office of school director.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 322, act of March 10, 1949 (P.L.30,
    10  No.14), known as the "Public School Code of 1949," amended June
    11  16, 1972 (P.L.449, No.138), is amended to read:
    12     Section 322.  Eligibility; Incompatible Offices.--Any citizen
    13  of this Commonwealth, having a good moral character, being
    14  eighteen (18) years of age or upwards, and having been a
    15  resident of the district for at least one (1) year prior to the
    16  date of his election or appointment, shall be eligible to the
    17  office of school director therein: Provided, That any person
    18  holding any office or position of profit under the government of
    19  any city of the first class, or the office of mayor, chief


     1  burgess, county commissioner, district attorney, city, borough,
     2  or township treasurer, member of council in any municipality,
     3  township commissioner, township supervisor, tax collector,
     4  assessor, assistant assessor, any comptroller, auditor,
     5  constable, executive director or assistant executive director of
     6  an intermediate unit, supervisor, principal, teacher, or employe
     7  of any school district, shall not be eligible as a school
     8  director in this Commonwealth. This section shall not prevent
     9  any district superintendent, assistant district superintendent,
    10  supervisor, teacher, or employe of any school district, from
    11  being a school director in a district other than the one in
    12  which he is so employed, and other than in a district with which
    13  the district in which he is employed operates a joint school or
    14  department. A school director shall not be eligible to the
    15  office of member of council in any municipality. Notwithstanding
    16  anything in this section or any other act to the contrary, no
    17  person shall be deemed ineligible for the office of school
    18  director solely on the basis that such person is a member of the
    19  classified service under any applicable civil service law.
    20     Section 2.  All acts or parts of acts inconsistent herewith
    21  are hereby repealed to the extent of any inconsistency.
    22     Section 3.  This act shall take effect in 60 days.
