                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, adding certain employees to the State
     3     Employees' Retirement System.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The definition of "State employee" in section
     7  5102 of Title 71, act of November 25, 1970 (P.L.707, No.230),
     8  known as the Pennsylvania Consolidated Statutes, is amended by
     9  adding a paragraph to read:
    10  § 5102.  Definitions.
    11     The following words and phrases as used in this part, unless
    12  a different meaning is plainly required by the context, shall
    13  have the following meanings:
    14     * * *
    15     "State employee." Any person holding a State office or
    16  position under the Commonwealth, employed by the State
    17  Government of the Commonwealth, in any capacity whatsoever,
    18  except an independent contractor or any person compensated on a
    19  fee basis, and shall include members of the General Assembly,

     1  and any officer or employee of the following:
     2     * * *
     3     (5)  an employee of a soil conservation district who is
     4  compensated for his services with funds contributed by the
     5  Commonwealth or a political subdivision thereof.
     6     * * *
     7     Section 2.  Section 5505 of Title 71 of the act is amended by
     8  adding a subsection to read:
     9  § 5505.  Contributions for the purchase of credit for creditable
    10           nonstate service.
    11     * * *
    12     (f)  Soil conservation district service.--Contributions on
    13  account of credit for service as an employee of a soil
    14  conservation district shall be determined by the board to be
    15  equal to the amount he would have paid as employee contributions
    16  together with statutory interest to date of purchase had he been
    17  a State employee during his period of service as an employee of
    18  a soil conversation district. The amount so determined by the
    19  State Employees' Retirement Board to be paid into the State
    20  Employees' Retirement System shall be the obligation of the
    21  employee who requested credit for previous service as an
    22  employee of a soil conservation district.
    23     Section 3.  Section 5507 of Title 71 of the act is amended by
    24  adding a subsection to read:
    25  § 5507.  Contributions by the Commonwealth and other employers.

    27     (c)  Contributions by soil conservation districts.--
    28  Contributions shall be made by soil conservation districts on
    29  behalf of employees thereof who are not paid out of Commonwealth
    30  funds.
