        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MARCH 27, 1979

                                     AN ACT

     1  Amending the act of June 18, 1974 (P.L.359, No.120), entitled
     2     "An act creating the Municipal Police Officers' Education and
     3     Training Commission; providing for the commission's
     4     membership, selection, compensation, and removal; providing
     5     for the powers and duties of the commission; providing for
     6     the appointment and duties of the chairman; providing for the
     7     act's applicability to the civil service laws; requiring
     8     training by certain political subdivisions and police
     9     departments; providing penalties for violation thereof; and
    10     making an appropriation," providing for courses of study and
    11     training of part-time police officers in municipalities other
    12     than cities of the second class, CERTAIN CITIES OF THE THIRD   <--
    13     CLASS and other than officers of counties of the second
    14     class, providing that regulations pertaining to such training
    15     be sent to the Chairmen of the Local Government Committee of
    16     both the Senate and the House of Representatives and further
    17     providing for reimbursement.

    18     The General Assembly of the Commonwealth of Pennsylvania
    19  hereby enacts as follows:
    20     Section 1.  Section 2, act of June 18, 1974 (P.L.359,
    21  No.120), referred to as the Municipal Police Education and
    22  Training Law, is amended by adding a definition to read:
    23     Section 2.  Definitions.--As used in this act:

    25     (7)  "Part-time police officer" means an officer whose

     1  average hours of work as a police officer per week is thirty      <--
     2  TWENTY-FOUR hours or less in a municipality other than a city of  <--
     3  the second class, OR A CITY OF THE THIRD CLASS WITH A POPULATION  <--
     4  OF 25,000 OR MORE, and other than officers of a county police
     5  force of a county of the second class.
     6     Section 2.  Paragraph (1) of section 5 of the act, is amended
     7  and section 5 is amended by adding paragraphs to read:
     8     Section 5.  Powers and Duties of the Commission.--The powers
     9  and duties of the commission shall be as follows:
    10     (1)  To establish the minimum courses of study and training
    11  for municipal police officers: Provided, That the courses of
    12  study and training of a part-time police officer shall be one
    13  hundred twenty hours to be completed within two years.
    14     (1.1)  Part-time police officers who have begun the present
    15  four hundred eighty hour course of study and training shall
    16  receive full credit for all courses which they have completed
    17  and which are part of the new one hundred twenty hour program
    18  described in paragraph (1).

    20     (7)  A copy of all rules and regulations pertaining to the
    21  course of study and training provided for part-time police
    22  officers in paragraph (1) shall be sent to the Chairman of the
    23  Local Government Committee in the Senate and to the Chairman of
    24  the Local Government Committee in the House of Representatives
    25  thirty days before such rules and regulations are published in
    26  the Pennsylvania Bulletin.
    27     (8)  TO ADOPT AS A REGULATION A SEQUENTIAL TYPE CURRICULUM,    <--
    28  BEGINNING WITH THE MOST IMPORTANT COURSES, FOR PART-TIME
    29  POLICEMEN. BEFORE THE CURRICULUM IS ADOPTED, IT SHALL BE
    30  SUBMITTED TO THE CHIEF CLERK OF THE SENATE AND HOUSE OF

     1  REPRESENTATIVES WHO SHALL CAUSE THE REGULATIONS TO BE PRINTED
     2  AND DISTRIBUTED AMONG ALL MEMBERS OF BOTH CHAMBERS IN THE SAME
     3  MANNER AS A REORGANIZATION PLAN. IF BOTH BODIES FAIL TO ACT
     4  WITHIN SIXTY DAYS OF RECEIPT OF SUCH REGULATION, OR WITHIN TEN
     5  LEGISLATIVE DAYS AFTER RECEIPT, WHICHEVER SHALL LAST OCCUR, THE
     6  REGULATION SHALL BE PROMULGATED PURSUANT TO THE PROVISIONS OF
     7  THE ACT OF JULY 31, 1968 (P.L.769, NO.240), REFERRED TO AS THE
     8  COMMONWEALTH DOCUMENTS LAW AND 45 PA.C.S. PART II (RELATING TO
     9  PUBLICATION AND EFFECTIVENESS OF COMMONWEALTH DOCUMENTS). IF
    10  EITHER CHAMBER DISAPPROVES THE REGULATION, SUCH INFORMATION
    11  SHALL BE CERTIFIED BY THE SPEAKER OF THE HOUSE OF
    12  REPRESENTATIVES OR PRESIDENT PRO TEMPORE OF THE SENATE TO THE
    13  DEPARTMENT, AND SUCH REGULATION SHALL NOT BE PROMULGATED AS A
    14  FINAL REGULATION.
    15     Section 3.  Subsection (a) of section 10 of the act is
    16  amended to read:
    17     Section 10.  Reimbursement of Expenses.--(a)  The commission,
    18  through the commissioner, shall provide for reimbursement to
    19  each political subdivision of one hundred per cent of the
    20  allowable tuition and the ordinary and necessary living and
    21  travel expenses incurred by their officers while attending
    22  [certified] municipal police basic training schools which meet
    23  the certification standards of the commission, providing said
    24  political subdivision adheres to the training standards
    25  established by the commission. The regular salary of police
    26  officers while attending approved schools, within the meaning of
    27  this act, shall be paid by the employing political subdivision.
    28  Fifty per cent of the regular salaries of police officers while
    29  attending approved schools within the meaning of the act shall
    30  be reimbursed by the commission to the employing political

     1  subdivision. This act shall not be construed to preclude the
     2  employing political subdivision from applying for grants from
     3  the Governor's Justice Commission under the Omnibus Crime
     4  Control and Safe Streets Act of 1968 for the payment of salary
     5  to a substitute police officer while the permanent officer is
     6  attending such school.

     8     Section 4.  This act shall take effect immediately.
