                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, relating to furnishing cigarettes,
     3     cigarette paper or tobacco to persons under sixteen years of
     4     age.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 6305 and 6306 of Title 18, act of
     8  November 25, 1970 (P.L.707, No.230), known as the Pennsylvania
     9  Consolidated Statutes, are amended to read:
    10  [§ 6305.  Sale of tobacco.
    11     A person is guilty of a summary offense if he sells tobacco,
    12  in any form, to any minor under the age of 16 years, or by
    13  purchase, gift or other means, furnishes tobacco, in any form,
    14  to a minor under the age of 16 years.]
    15  § 6306.  Furnishing cigarettes, [or] cigarette papers or
    16           tobacco.
    17     (a)  Offense defined.--A person commits an offense if he
    18  furnishes to any minor, under the age of 16 years, by gift, sale
    19  or otherwise, any cigarettes, [or] cigarette paper or tobacco,

     1  in any form.
     2     (b)  Grading.--Whoever commits an offense under this section
     3  shall, upon being convicted thereof in a summary proceeding, be
     4  sentenced [for the first offense] to pay a fine not exceeding
     5  [$25 and for the second offense shall be fined not exceeding
     6  $100; and for the third or subsequent offense shall be guilty of
     7  a misdemeanor of the third degree] $50.
     8     Section 2.  This act shall take effect in 60 days.
