AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," providing for public hearings prior
6 to closing existing classroom structures.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 709, act of March 10, 1949 (P.L.30,
10 No.14), known as the "Public School Code of 1949," added August
11 26, 1953 (P.L.1451, No.420), is amended to read:
12 Section 709. Lease of Unused and Unnecessary Lands and
13 Buildings.--The board of school directors of any district may
14 lease for any lawful purpose, other than educational use, unused
15 and unnecessary lands and buildings of the district pending the
16 sale thereof or until such time as the board shall decide again
17 to make use thereof for school purposes. Terms and conditions of
18 lease shall be fixed by the board in the motion or resolution
19 authorizing the lease. All rents collected shall be paid into
20 the general fund of the district. However, no classroom building
1 shall be closed to further use until the board of school
2 directors has conducted at least two (2) public hearings which
3 shall be open to residents of the district. The board of school
4 directors shall provide public notice of such hearings at least
5 two (2) weeks in advance of each such hearing.
6 Section 2. This act shall take effect immediately.
