                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing certain exceptions from limitations on
     3     weight.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4902 of Title 75, act of November 25,
     7  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     8  Statutes, is amended to read:
     9  § 4902.  Restrictions on use of highways and bridges.
    10     (a)  General rule.--The department and local authorities with
    11  respect to highways and bridges under their jurisdictions may
    12  prohibit the operation of vehicles and may impose restrictions
    13  as to the weight or size of vehicles operated upon a highway or
    14  bridge whenever the highway or bridge, by reason of
    15  deterioration or rain, snow or other climatic conditions, may be
    16  damaged or destroyed unless the use of vehicles is prohibited or
    17  the permissible weights reduced.
    18     (b)  Permit with bond.--The department and local authorities


     1  may issue permits for movement of vehicles of size and weight in
     2  excess of the restrictions promulgated under subsection (a) with
     3  respect to highways and bridges under their jurisdiction,
     4  conditioned upon the execution of a surety bond by the user in
     5  favor of the department or local authorities to cover the cost
     6  of repairs necessitated by the movement.
     7     (c)  Restrictions from traffic conditions.--The department
     8  and local authorities with respect to highways and bridges under
     9  their jurisdictions may prohibit the operation of vehicles and
    10  may impose restrictions as to the weight or size of vehicles
    11  operated upon a highway or bridge by reason of hazardous traffic
    12  conditions or other safety factors.
    13     (d)  Erection of signs.--The department and the local
    14  authorities shall erect or cause to be erected and maintained
    15  signs designating the restrictions at each end of that portion
    16  of any highway or bridge restricted as provided in subsections
    17  (a) and (c). The restrictions shall not be effective unless
    18  signs are erected and maintained in accordance with this
    19  subsection.
    20     (d.1)  Local delivery exception.--Any restrictions imposed by
    21  the department or local authorities regarding maximum weights on
    22  certain highways or bridges pursuant to subsection (a) or (c)
    23  shall not apply to the following vehicles where alternate routes
    24  are not feasible:
    25         (1)  School buses on their normal routes.
    26         (2)  Vehicles making residential deliveries.
    27         (3)  Vehicles transporting agricultural produce from
    28     farms.
    29     (e)  Penalty.--Any person operating a vehicle or combination
    30  upon a highway or bridge in violation of a prohibition or

     1  restriction imposed under subsection (a) is guilty of a summary
     2  offense and shall, upon conviction, be sentenced to pay a fine
     3  of $75 for each 500 pounds, or part thereof, in excess of 3,000
     4  pounds over the maximum allowable weight.
     5     Section 2.  This act shall take effect in 60
     6  days.
