                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, denying retirement benefits to persons
     3     convicted of certain crimes and further providing for
     4     assignment of retirement benefits.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 71, act of November 25, 1970 (P.L.707,
     8  No.230), known as the Pennsylvania Consolidated Statutes, is
     9  amended by adding a section to read:
    10  § 5312.  Benefits forfeited.
    11     (a)  Forfeiture.--Any member of the fund who is convicted of
    12  any crime involving moral turpitude in connection with his
    13  official duties as an officer or employee of the Commonwealth
    14  shall forfeit his right to any retirement benefits except a
    15  return of his contributions less any claims of the Commonwealth.
    16     (b)  Assignment of funds for loss.--Any loss to the
    17  Commonwealth as determined by the appropriate officer of the
    18  Commonwealth is an obligation to the Commonwealth. A member of
    19  the fund who commits a crime which results in a loss of


     1  Commonwealth money, by the act of committing the crime, thereby
     2  assigns his retirement benefits including his contributions to
     3  the fund to the Commonwealth to the extent of the loss. The
     4  assignment shall be determined and paid by the board in the
     5  manner provided for assignment of funds under section 5953
     6  (relating to taxation, attachment and assignment of funds).
     7     Section 2.  This act shall take effect immediately.
