                                     AN ACT

     1  Amending the act of June 16, 1836 (P.L.715, No.186), entitled
     2     "An act relating to Reference and Arbitration," further
     3     providing for appeals from arbitrators' awards.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Clause V. of section 27, act of June 16, 1836
     7  (P.L.715, No.186), referred to as the Reference and Arbitration
     8  Law, amended March 15, 1956 (P.L.1279, No.391), is amended to
     9  read:
    10     Section 27.  Either party may appeal from an award of
    11  arbitrators, to the court in which the cause was pending at the
    12  time the rule or agreement of reference was entered, under the
    13  following rules, regulations and restrictions, viz.:
    14     * * *
    15     V.  In all cases under section 8.1 hereof, any party
    16  appealing shall first repay to the county the fees of the
    17  members of the board of arbitrators herein provided for, but not
    18  exceeding fifty percent of the amount in controversy. The
    19  balance of the arbitrator's fees shall be absorbed and paid by

     1  the county. Such fees shall not be taxed as costs or be
     2  recoverable in any proceeding. All appeals shall be de novo;
     3  however, the several courts of common pleas may, by rules of
     4  court, provide for the exclusion of testimony offered by
     5  witnesses on appeal who did not testify at the arbitration
     6  hearing, unless good cause is shown for not calling the profered
     7  witness at the arbitration hearing.
     8     Section 2.  This act shall take effect in 60 days.
