           REPRESENTATIVES, AS AMENDED, JANUARY 30, 1978

                                     AN ACT

     1  Authorizing the Board of Schuylkill County Municipal Authority
     2     to transfer certain Project 70 lands in New Castle, Ryan and
     3     Blythe Townships in Schuylkill County to Crown American
     4     Corporation in exchange for a certain parcel of land
     5     containing the Mud Run Dam.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Authorization of Transfer; Conditions.--Pursuant
     9  to the requirements of section 20(b), act of June 22, 1964 (Sp.
    10  Sess. P.L.131, No.8), known as the "Project 70 Land Acquisition
    11  and Borrowing Act," the General Assembly authorizes the Board of
    12  the Schuylkill County Municipal Authority to transfer the
    13  hereinafter described land in New Castle, Ryan and Blythe
    14  Townships, Schuylkill County, to Crown American Corporation in
    15  exchange for a certain parcel of land containing the Mud Run
    16  Dam.
    17     Such land shall be free of the restrictions on use and
    18  alienation prescribed by section 20, act of June 22, 1964 (Sp.
    19  Sess. P.L.131, No.8), known as the "Project 70 Land Acquisition

     1  and Borrowing Act," upon:
     2     (1)  Completion of the exchange transfer to the authority of
     3  a certain parcel of land containing the Mud Run Dam; and
     4     (2)  Execution and filing of a document of exchange and
     5  release, citing such exchange and release of the said land from
     6  the restrictions on use and alienation prescribed by section
     7  20(b) of said act.
     8     Section 2.  Description of Project 70 Land to be
     9  Transferred.--The land to be transferred by the Board of the
    10  Schuylkill County Municipal Authority to Crown American
    11  Corporation in exchange for the transfer of a certain parcel or
    12  property containing the Mud Run Dam is more particularly
    13  described as follows:
    14     All that certain piece, parcel or tract of land situate in
    15  New Castle, Ryan and Blythe Townships, Schuylkill County,
    16  Pennsylvania, bounded and described as follows, to wit:
    17     Beginning at an iron pin in the common line of lands now or
    18  late of Mt. Laurel Enterprises and Schuylkill County Municipal
    19  Authority; thence along said Mt. Laurel lands north 88 degrees
    20  29 minutes 00 seconds east 3,034.56 feet to an iron pin located
    21  in the western right-of-way of Legislative Route No. 161
    22  southbound; thence along said right-of-way for the following 12
    23  courses and distances (1)  south 29 degrees 35 minutes 30
    24  seconds east, 178.71 feet to an iron pin (2)  north 60 degrees
    25  24 minutes 30 seconds east, 113.00 feet to an iron pin (3)
    26  south 33 degrees 24 minutes 30 seconds east, 82.50 feet to an
    27  iron pin (4)  south 53 degrees 27 minutes 00 seconds west, 15.00
    28  feet to an iron pin (5)  south 39 degrees 46 minutes 30 seconds
    29  east, 61.02 feet to an iron pin (6)  south 29 degrees 37 minutes
    30  30 seconds east, 149.42 feet to an iron pin (7)  by a curve to

     1  the right with a radius of 788.12 feet having a chord of south
     2  26 degrees 50 minutes 00 seconds east, 76.77 feet to an iron pin
     3  (8)  by a curve to the right with a radius of 606.66 feet having
     4  a chord of south 13 degrees 53 minutes 00 seconds east, 46.40
     5  feet to an iron pin (9)  south 11 degrees 41 minutes 30 seconds
     6  east, 171.74 feet to an iron pin (10)  by a curve to the right
     7  with a radius of 382.45 feet having a chord of south 5 degrees
     8  28 minutes 30 seconds east, 82.83 feet to an iron pin (11)
     9  south 00 degrees 44 minutes 30 seconds west, 85.62 feet to an
    10  iron pin (12)  north 89 degrees 15 minutes 30 seconds west,
    11  10.00 feet to an iron pin and other lands of the aforementioned
    12  Municipal Authority; thence along said Municipal Authority Lands
    13  for the following four courses and distances (1)  south 60
    14  degrees 00 minutes 00 seconds west, 570.00 feet to an iron pin
    15  (2)  south 82 degrees 00 minutes 00 seconds west, 1,200.00 feet
    16  to an iron pin (3)  north 76 degrees 40 minutes 00 seconds west,
    17  1,183.00 feet to an iron pin (4)  north 34 degrees 05 minutes 00
    18  seconds west, 1,089.69 feet to the point of beginning.
    19     Containing 74.946 acres as bounded and described according to
    20  a survey by James J. Sterner, Jr., Professional Engineer No.
    21  21084-E.
    22     SECTION 3.  DESCRIPTION OF LANDS TO BE ACQUIRED BY             <--
    23  AUTHORITY.--THE LAND TO BE CONVEYED BY THE CROWN AMERICAN
    24  CORPORATION TO THE SCHUYLKILL COUNTY MUNICIPAL AUTHORITY IN
    25  EXCHANGE FOR THE TRANSFER OF THE PROJECT 70 LAND DESCRIBED IN
    26  SECTION 2 IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:
    27     ALL THAT CERTAIN PIECE, PARCEL OR TRACT OF LAND SITUATE IN
    28  NEW CASTLE TOWNSHIP, SCHUYLKILL COUNTY, PENNSYLVANIA, BOUNDED

     3  THENCE SOUTH 83 DEGREES 44 MINUTES WEST, A DISTANCE OF 110 FEET,
     4  MORE OR LESS, TO A POINT; THENCE SOUTH 72 DEGREES 55 MINUTES
     5  WEST, A DISTANCE OF 6,390 FEET, MORE OR LESS, TO A POINT; THENCE
     6  NORTH 30 DEGREES 30 MINUTES WEST A DISTANCE OF 3,050 FEET, MORE

    19     SECTION 4.  RIGHT OF WAY.--CROWN AMERICAN CORPORATION SHALL
    20  ALSO CONVEY TO THE SCHUYLKILL COUNTY MUNICIPAL AUTHORITY AN
    21  EASEMENT OR RIGHT OF WAY TO ENABLE THE AUTHORITY TO GAIN ACCESS
    22  TO MUD RUN DAM. SAID EASEMENT OR RIGHT OF WAY IS DESCRIBED AS
    23  FOLLOWS:

    25  NEW CASTLE TOWNSHIP, SCHUYLKILL COUNTY, PENNSYLVANIA, BOUNDED

    18  RIGHT OF WAY OF A UNIFORM WIDTH OF 20 FEET AS BOUNDED AND
    19  DESCRIBED ACCORDING TO A SURVEY BY JAMES J. STERNER, JR.,
    20  PROFESSIONAL ENGINEER #21084-E.
    21     SECTION 5.  PROJECT 70 CONDITIONS.--THE DEED FROM CROWN
    22  AMERICAN CORPORATION TO THE SCHUYLKILL COUNTY MUNICIPAL
    23  AUTHORITY SHALL CONTAIN THE FOLLOWING CLAUSE:
    24     THIS INDENTURE IS GIVEN TO PROVIDE LAND FOR RECREATION,
    25  CONSERVATION AND HISTORICAL PURPOSES, AS SAID PURPOSES ARE
    26  DEFINED IN THE ACT OF JUNE 22, 1964 (SP. SESS., P.L.131, NO.8),
    27  KNOWN AS THE "PROJECT 70 LAND ACQUISITION AND BORROWING ACT."
    28     Section 6.  Effective Date.--This act shall take effect
    29  immediately.
