                                     AN ACT

     1  Amending the act of October 20, 1966 (3rd Sp.Sess., P.L.96,
     2     No.6), entitled "An act relating to mental health and mental
     3     retardation; authorizing county programs and amending,
     4     revising and changing the laws relating thereto and making an
     5     appropriation," providing for the Advisory Committee on
     6     Mental Health and the Advisory Committee on Mental
     7     Retardation.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Clauses (2) and (3) of section 201, act of
    11  October 20, 1966 (3rd Sp.Sess., P.L.96, No.6), known as the
    12  "Mental Health and Mental Retardation Act of 1966," are amended
    13  to read:
    14     Section 201.  General Powers and Duties of the Department.--
    15  The department shall have power, and its duty shall be:
    16     * * *
    17     (2)  To make, with the advice of the Advisory Committee for
    18  Mental Health and the Advisory Committee for Mental Retardation
    19  and enforce all regulations necessary and appropriate to the
    20  proper accomplishment of the mental health and mental
    21  retardation duties and functions imposed by this act. Such

     1  regulations shall not become effective until the department
     2  shall have given the local authorities thirty days written
     3  notice of the proposed regulations and afforded the local
     4  authorities the opportunity for a hearing before the department
     5  on the proposed regulations.
     6     (3)  To consult with and assist each county in carrying out
     7  mental health and mental retardation duties and functions and
     8  where necessary after thirty days written notice to the counties
     9  affected and an opportunity for such counties for a hearing
    10  before the department and with the advice of the Advisory
    11  Committee for Mental Health and the Advisory Committee for
    12  Mental Retardation to require two or more counties to join in
    13  establishing a program to provide the services required by this
    14  act.

    16     Section 2.  This act shall take effect immediately.
