                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Department of Public Welfare and the
     3     Governor, to convey to the Township of South Fayette 12.378
     4     acres of land, more or less, situate in South Fayette
     5     Township, Allegheny County, Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Department of Public Welfare and the Governor,
    10  is hereby authorized and directed on behalf of the Commonwealth
    11  of Pennsylvania, to grant and convey to the Township of South
    12  Fayette, the following tract of land, situate in the Township of
    13  South Fayette, Allegheny County, and Commonwealth of
    14  Pennsylvania, bounded and described as follows:
    15     Beginning at a corner common to property of the grantors
    16  herein, property now or formerly the Municipal Authority of the
    17  Township of South Fayette and Lot No. 76 in the Fairview Manor
    18  Plan of Lots No. 4; thence from said point of beginning along
    19  line dividing property of grantors herein from property now or


     1  formerly the Municipal Authority of the Township of South
     2  Fayette south 26 degrees 42 minutes west a distance of 380.28
     3  feet to a point at the corner common to property now or formerly
     4  the Municipal Authority of the Township Authority, property now
     5  or formerly M. Knez and property of the grantors herein; thence
     6  by line common to grantors herein and property now or formerly
     7  M. Knez and Ryan Homes, Inc., south 66 degrees 22 minutes 30
     8  seconds east a distance of 695.59 feet to a point; thence by
     9  line common to property of grantors herein and property now or
    10  formerly Ryan Homes, Inc., south 30 degrees 42 minutes 30
    11  seconds east a distance of 631.51 feet to a point; thence by a
    12  line through property of the grantors herein north 34 degrees 23
    13  minutes 30 seconds east a distance of 664.30 feet to a point;
    14  thence by same north 62 degrees 12 minutes 30 seconds west a
    15  distance of 1315.76 feet to a point at the southeasterly corner
    16  of Lot No. 76 in Fairview Manor Plan of Lots No. 4, the place of
    17  beginning. This lot contains 12.378 acres.
    18     The conveyance shall be made under and subject to all
    19  easements, servitudes and rights of others, including but not
    20  confined to streets, roadways, and rights of any telephone,
    21  telegraph, water, electric, sewer, gas or pipeline companies, as
    22  well as under and subject to any interest, estates, or tenancies
    23  vested in third persons, whether or not appearing of record, for
    24  any portion of the land or improvements erected thereon.
    25     Section 2.  The deed of conveyance shall contain a clause
    26  that the lands conveyed shall be used for park and recreational
    27  purposes by South Fayette Township and if at any time the said
    28  township or its successor in function conveys said property or
    29  authorizes or permits said property to be used for any purpose
    30  other than park and recreational purposes, the title thereto

     1  shall immediately revert to and revest in the Commonwealth of
     2  Pennsylvania.
     3     Section 3.  The deed of conveyance shall be approved by the
     4  Department of Justice and shall be executed by the Secretary of
     5  General Services in the name of the Commonwealth of
     6  Pennsylvania.
     7     Section 4.  This act shall take effect immediately.
