                                     AN ACT

     1  Amending the act of January 22, 1968 (P.L.42, No.8), entitled,
     2     "An act empowering and authorizing the Department of
     3     Community Affairs to establish and administer certain grant
     4     programs for the betterment of mass transportation systems
     5     and facilities throughout the Commonwealth; providing for
     6     State grants to transportation companies, municipalities,
     7     counties, or their instrumentalities and to agencies and
     8     instrumentalities of the Commonwealth for studies, research,
     9     demonstration programs, promotion programs, purchase of
    10     service projects, and capital improvement projects under
    11     certain conditions; authorizing grants by counties or
    12     municipalities in metropolitan areas to local transportation
    13     organizations," requiring certain transit system operators to
    14     allow reduced rates for senior citizens and making a repeal.

    15     The General Assembly of the Commonwealth of Pennsylvania
    16  hereby enacts as follows:
    17     Section 1.  Subsection (b) of section 2, act of January 22,
    18  1968 (P.L.42, No.8), known as the "Pennsylvania Urban Mass
    19  Transportation Assistance Law of 1967," amended December 27,
    20  1972 (P.L.1631, No.339), is amended to read:
    21     Section 2.  Findings and Declaration of Policy.--* * *
    22     (b)  Therefore, it is hereby declared to be the policy of the
    23  General Assembly of the Commonwealth of Pennsylvania to promote

     1  the health, safety, convenience and welfare of its inhabitants
     2  through the department by means of State financial assistance
     3  for the development of efficient and coordinated urban common
     4  carrier mass transportation systems, facilities and services and
     5  to provide [free] local transit for the elderly at reduced
     6  rates. Such purposes are hereby declared to be public uses for
     7  which State moneys may be spent.
     8     Section 2.  Clause (5) of section 4 of the act, added
     9  December 27, 1972 (P.L.1631, No.339), is repealed.
    10     Section 3.  The act is amended by adding a section to read:
    11     Section 8.1.  Reduced Rates for the Elderly.--(a)  All local
    12  transportation organizations and all transportation companies
    13  receiving grants or other assistance under this act shall
    14  provide transit service to persons sixty-five years of age or
    15  older on common carrier mass transportation systems when such
    16  passage is by local public bus, trolley or subway-elevated
    17  systems during nonpeak riding hours and on holidays and
    18  weekends, at the rate of ten cents (10¢) per ride.
    19     (b)  The department shall promulgate the rules and
    20  regulations necessary to implement this section.
    21     Section 4.  This act shall take effect in six months.
