A JOINT RESOLUTION
1 Proposing an amendment to the Constitution of the Commonwealth
2 of Pennsylvania providing for certain legislative actions
3 when a budget is not adopted before the end of a fiscal year.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby resolves as follows:
6 Section 1. The following amendment to the Constitution of
7 the Commonwealth of Pennsylvania is proposed in accordance with
8 the provisions of Article XI thereof:
9 That section 13 of Article VIII be amended by adding a
10 subsection to read:
11 § 13. Appropriations.

13 (c) If the General Assembly has not adopted a budget, (i)
14 within 30 days prior to the end of a fiscal year, then the
15 legislative activities of the General Assembly shall be
16 restricted solely to matters concerning taxation and the budget,
17 (ii) within 15 days prior to the end of a fiscal year, then the
18 General Assembly shall remain in continuous session until the
1 budgetary problems are solved. Stopgap legislation of a
2 budgetary nature shall not remove the effect of this limitation.
3 The limitation shall not apply to emergency legislation
4 necessary to cope with situations deemed an emergency by the
5 Governor.
