AN ACT
1 Prohibiting the Department of Public Welfare from entering into
2 certain contracts.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Declaration of legislative findings and purposes.
6 The General Assembly finds that it may be desirable in
7 certain periods of fiscal difficulty for the Department of
8 Public Welfare to enter into contracts or agreements with
9 banking institutions which provide for the direct repayment by
10 the department to such institutions for the amount of money
11 loaned to welfare recipients. The purpose of this act is to
12 prohibit the department from entering into such contracts or
13 agreements unless the department can, by the use of such
14 contracts or agreements, provide for the Statewide availability
15 of loans open to all welfare recipients in all areas of the
16 Commonwealth.
17 Section 2. Definitions.
18 The following words and phrases when used in this act shall
1 have the meanings given to them in this section, unless the
2 context clearly indicates otherwise:
3 "Banking institution." Any banking institution chartered by
4 the Federal Government or by the Commonwealth of Pennsylvania.
5 "Department." The Department of Public Welfare.
6 Section 3. Certain contracts prohibited.
7 The department shall not enter into any contract or agreement
8 with any banking institution for the direct repayment of money
9 loaned to welfare recipients unless the department can provide,
10 through the use of such contracts or agreements, for the
11 Statewide availability of loans open to all welfare recipients
12 in all areas of the Commonwealth.
13 Section 4. Effective date.
14 This act shall take effect immediately.
