A JOINT RESOLUTION
1 Proposing an amendment to the Constitution of the Commonwealth
2 of Pennsylvania, further providing for appropriations.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby resolves as follows:
5 Section 1. The following amendment to the Constitution of
6 the Commonwealth of Pennsylvania is proposed in accordance with
7 the provisions of Article XI thereof.
8 That section 13 of Article VIII be amended to read:
9 § 13. Appropriations.
10 (a) Operating budget appropriations made by the General
11 Assembly shall not exceed the actual and estimated revenues and
12 surplus available in the same fiscal year.
13 (b) The General Assembly shall adopt a capital budget for
14 the ensuing fiscal year.
15 (c) The General Assembly shall adopt an operating budget
16 before the end of the fiscal year for the ensuing fiscal year.
17 Failure to do so shall result in the forfeiture by its members
1 of the salaries, expenses and other forms of compensation, as
2 well as all benefits, for the period of time between the end of
3 the fiscal year and the time at which the operating budget shall
4 be adopted.
5 Further, The General Assembly, failing to adopt an operating
6 budget by the end of the fiscal year for the ensuing fiscal
7 year, shall be prohibited from conducting any other business
8 including committee meetings and hearings until the enactment of
9 an operating budget. The members of the General Assembly shall
10 be obligated to meet in session every day after the end of the
11 fiscal year until such time as the General Assembly shall adopt
12 an operating budget.
13 (d) All meetings related to the budget, including those of a
14 conference committee, shall be open to the public.
