AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, providing for trespass on public 3 school property. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3503 of Title 18, act of November 25, 7 1970 (P.L.707, No.230), known as the Pennsylvania Consolidated 8 Statutes is amended by adding a subsection to read: 9 § 3503. Criminal trespass. 10 * * * 11 (b.1) School property.-- 12 (1) The following words and phrases when used in this 13 subsection shall have, unless the context clearly indicates 14 otherwise, the meanings given to them in this paragraph: 15 "Enter or remain unlawfully." To enter or remain upon 16 property without license or privilege to do so. A person who 17 enters or remains in or upon property which is at the time 18 open to the public does so with license and privilege unless
1 he fails or refuses to obey an order or directive not to 2 enter or remain personally communicated to him or publically 3 announced by one who is authorized to give such an order or 4 unless he fails or refuses to obey a directive embodied in a 5 posted notice which directs visitors to report to an 6 administration office located on the property before 7 proceeding elsewhere on the property. A license or privilege 8 to enter or remain on property which is only partly open to 9 the public is not a license or privilege to enter or remain 10 on any part of the property which is not open to the public. 11 "Public school property." Any building, structure or 12 land owned or leased by a school district. 13 "School district." All school districts, authorities, 14 and educational institutions receiving appropriated moneys 15 from this Commonwealth. 16 (2) A person commits an offense if, knowing he is not 17 licensed or privileged to do so, he enters or remains 18 unlawfully in any public school property. 19 (3) An offense under this subsection is a misdemeanor of 20 the second degree. 21 * * * 22 Section 2.
