                                     AN ACT

     1  Amending the act of July 19, 1974 (P.L.489, No.176), entitled
     2     "An act providing for a compensation system for persons
     3     injured in motor vehicle accidents; requiring insurance for
     4     all motor vehicles required to be registered in Pennsylvania;
     5     defining compensable damage in motor vehicle accident cases;
     6     establishing an assigned claims plan; providing for
     7     arbitration; imposing powers and duties on courts, the
     8     Department of Transportation and the Insurance Commissioner;
     9     prohibiting certain discrimination; and providing penalties,"
    10     further providing for the obligations of the owner upon
    11     termination of security.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Subsection (d) of section 104, act of July 19,
    15  1974 (P.L.489, No.176), known as the "Pennsylvania No-fault
    16  Motor Vehicle Insurance Act," is amended to read:
    17  § 104.  Required motor vehicle insurance.

    19     (d)  Obligations upon termination of security.--An owner of a
    20  motor vehicle who ceases to maintain the security required in
    21  accordance with this act shall immediately surrender the
    22  registration certificate and license plates for the vehicle to
    23  the department and may not operate or permit operation of the

     1  vehicle in this Commonwealth until security has again been
     2  furnished as required in accordance with this act. A person
     3  other than the owner who ceases to maintain such security shall
     4  immediately notify the owner and the department. [who] The owner
     5  of such an insecured vehicle shall immediately surrender the
     6  registration certificate and registration plate for the vehicle
     7  to the department and may not operate or permit operation of the
     8  vehicle until security has again been furnished. An insurer who
     9  has issued a contract of insurance and knows or has reason to
    10  believe the contract is for the purpose of providing security
    11  shall immediately give notice to the department of the
    12  termination of the insurance. If the commissioner or department
    13  withdraws approval of security provided by a self-insurer or
    14  knows that the conditions for self-insurance have ceased to
    15  exist, he shall immediately give notice thereof to the
    16  department. These requirements may be modified or waived by the
    17  department.
    18     Section 2.  This act shall take effect in 60 days.
