A JOINT RESOLUTION 1 Proposing an amendment to the Constitution of the Commonwealth 2 of Pennsylvania prohibiting retired judges over age 75 to 3 perform judicial service. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby resolves as follows: 6 Section 1. The following amendment to the Constitution of 7 the Commonwealth of Pennsylvania is proposed in accordance with 8 the provisions of Article XI thereof: 9 That section 16, Article V be amended to read: 10 § 16. Compensation and retirement of justices, judges and 11 justices of the peace. 12 (a) Justices, judges and justices of the peace shall be 13 compensated by the Commonwealth as provided by law. Their 14 compensation shall not be diminished during their terms of 15 office, unless by law applying generally to all salaried 16 officers of the Commonwealth. 17 (b) Justices, judges and justices of the peace shall be 18 retired upon attaining the age of 70 years. Former and retired
1 justices, judges and justices of the peace shall receive such 2 compensation as shall be provided by law. No compensation shall 3 be paid to any justice, judge or justice of the peace who is 4 suspended or removed from office under section 18 of this 5 article or under Article VI. 6 (c) A former or retired justice or judge age 75 or under 7 may, with his consent, be assigned by the Supreme Court on 8 temporary judicial service as may be prescribed by rule of the 9 Supreme Court.
