AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, prohibiting the practice of employing 3 an alien not lawfully admitted to the United States of 4 America. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Title 18, act of November 25, 1970 (P.L.707, 8 No.230), known as the Pennsylvania Consolidated Statutes, is 9 amended by adding a section to read: 10 § 7325. Employment of illegal alien. 11 (a) Offense defined.--Any person who, knowingly employs an 12 illegal alien, contracts for the employment of an illegal alien, 13 acts as an agent for a person in securing the employment of an 14 illegal alien, acts as a contractor for the employment of an 15 illegal alien, or for a fee refers an illegal alien for 16 employment, commits a misdemeanor of the third degree. Each 17 illegal alien employed shall constitute a separate offense. 18 (b) Second and subsequent offense.--Any person who violates
1 the provisions of subsection (a) within two months of a prior 2 conviction commits a misdemeanor of the first degree. 3 (c) Definitions.--As used in this section the following 4 words and phrases shall have the meanings given to them in this 5 subsection: 6 "Contractor." Any individual, group, corporation or 7 association who, for a fee from an employer, offers the employer 8 a group of individuals to perform work. 9 "Employer." Any person, group, association or corporation 10 who seeks to get certain actions to tasks performed in return 11 for the payment of compensation. 12 "Illegal alien." Any individual who is in the United States 13 of America in violation of the provisions of the act of June 27, 14 1952 (8 U.S.C § 1101 et seq.), known as the "Immigration and 15 Nationality Act," as amended, or any alien who has not been 16 given permission by the United States Immigration and 17 Naturalization Service to accept employment. 18 Section 2.
