AN ACT 1 Amending the act of June 24, 1937 (P.L.2017, No.396), entitled 2 "An act creating in each county (except of the first class) 3 as a separate corporation, and in each city of the first and 4 second class as a part of the city government, an institution 5 district for the care and maintenance of certain indigent 6 persons and children; prescribing the powers and duties of 7 county commissioners, county treasurers, city departments of 8 public welfare, the State Department of Welfare and the State 9 Department of Public Assistance in respect thereto; 10 abolishing certain poor districts and terminating the terms 11 of directors, overseers, guardians and managers of the poor 12 and poor district auditors, and providing for the temporary 13 employment of certain of them; providing for the transfer, 14 vesting, sale and disposition of the property of poor 15 districts and the payment of their obligations; imposing 16 certain existing obligations on institution districts and on 17 the Commonwealth; regulating the affairs of poor districts 18 until abolished; revising, amending, changing and 19 consolidating the law relating to the care of the poor; and 20 repealing existing laws," further providing for contracts for 21 hospitals which are part of the institution district. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Section 315 of the act of June 24, 1937 25 (P.L.2017, No.396), known as the "County Institution District 26 Law," amended October 7, 1955 (P.L.662, No.184), is amended to
1 read: 2 Section 315. Contracts.--It shall be the duty of the 3 commissioners to purchase all supplies for the maintenance of 4 the inmates of the institutions under their supervision, and to 5 contract for and purchase all services and personal property for 6 county institution district officers and agencies. They shall 7 where possible anticipate the needs of the various officers and 8 agencies of the district, and endeavor to purchase in wholesale 9 quantities where practicable and where savings could be achieved 10 thereby. The commissioners may make contracts and purchases for 11 all purposes expressly or impliedly authorized by law. 12 [All] Except as otherwise provided in the third paragraph of <-- 13 this section, all contracts and purchases made by the 14 commissioners for the county institution district shall be made 15 in the same manner and under the same procedure as if they were 16 being made for the county, and shall be subject to the same 17 restrictions, regulations and controls provided by law for 18 county contracts and purchases. 19 The commissioners may enter into contracts and make purchases 20 for hospitals which are part of the institution district, by 21 purchasing off or participating in contracts for materials, 22 supplies and equipment entered into by a nonprofit cooperative 23 hospital service association. The institution district shall be <-- 24 exempt from existing statutory requirements governing 25 advertising and competitive bidding with respect to the purchase 26 of materials, supplies and equipment under this paragraph. 27 Section 2.
