           HASAY, COLE, CALTAGIRONE, WENGER, BITTINGER, STEWART, BELOFF,
           SHUMAN, ZITTERMAN, MRS. WISE, MESSRS. SWEET, GRAY AND
           LETTERMAN, JUNE 15, 1977

        SENATOR MELLOW, ENVIRONMENTAL RESOURCES, IN SENATE, AS AMENDED,
           DECEMBER 14, 1977

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," authorizing the commission to
     5     purchase wildlife stamps, shoulder patches, decals and such
     6     other similar items, solicit funds to promote the cause of
     7     wildlife management, and making editorial changes.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 1401, act of June 3, 1937 (P.L.1225,       <--
    11  No.316), known as "The Game Law," amended June 27, 1973 (P.L.83,
    12  No.36), is amended by adding a subsection to read:
    13     SECTION 1.  SUBSECTION (W) OF SECTION 1401, ACT OF JUNE 3,     <--
    14  1937 (P.L.1225, NO.316), KNOWN AS "THE GAME LAW," SUBSECTION (W)
    15  AMENDED JUNE 13, 1957 (P.L.298, NO.154), IS AMENDED AND A
    16  SUBSECTION IS ADDED TO READ:
    17     Section 1401.  Continuance of Game Fund; Appropriation.--All
    18  license fees, fines, permit fees, and other moneys received and


     1  collected (a) under the provisions of any law repealed and
     2  replaced by this act, and now held in the State Treasury as the
     3  Game Fund, or (b) that may be hereafter paid into the State
     4  Treasury under the provisions of any act so repealed or
     5  replaced, or (c) that may be paid into the State Treasury under
     6  the provisions of this act, shall be placed in the separate fund
     7  known as "The Game Fund," and shall be held separately and apart
     8  solely for the following purposes:
     9     * * *
    10     (v)  For the purchase of wildlife stamps, shoulder patches,    <--
    11  decals and such other similar items as the commission shall
    12  determine to be used for the purpose of promoting wildlife
    13  management. Such materials may be sold by the commission at a
    14  fee determined by them or given away free of charge in
    15  recognition of promoting the cause of wildlife management;
    16     Section 2.  Subsection (w) of section 1401 of the act amended
    17  June 13, 1957 (P.L.298, No.154), is amended to read:
    18     (w)  The commission shall have the right to acquire title to
    19  or control of lands and buildings by purchase, lease, gift, or
    20  otherwise, direct from the owners or persons having legal
    21  control thereof, as in this act hereinbefore provided, without
    22  submission to or approval by the Department of [Property and
    23  Supplies] General Services. The commission shall also have the
    24  right to solicit and accept donations from any person, firm,
    25  corporation or association, which shall be placed in "The Game
    26  Fund," AUDITED BY THE AUDITOR GENERAL and used for the purposes   <--
    27  set forth in this section. The commission may also purchase
    28  direct, without prior confirmation of the Department of
    29  [Property and Supplies] General Services, all game and game food
    30  for its game farms and elsewhere as needed in any amount. The

     1  commission also may, without prior confirmation of the
     2  Department of [Property and Supplies] General Services, make
     3  direct field purchases of materials, supplies, and equipment for
     4  the maintenance and development of its system of refuges,
     5  hunting grounds, game farms, game propagation areas, and
     6  buildings and repairs thereon, and for other field activities,
     7  at the most advantageous prices available, in amounts not to
     8  exceed one hundred dollars in a single purchase. In the purchase
     9  of all other supplies, equipment, printing and other purchases
    10  necessary for the conduct of the work of the commission, such
    11  purchases shall be made through the Department of [Property and
    12  Supplies] General Services as purchasing agent;

    14     (Z.2)  FOR THE PURCHASE OF WILDLIFE STAMPS, SHOULDER PATCHES,  <--
    15  DECALS AND SUCH OTHER SIMILAR ITEMS AS THE COMMISSION SHALL
    16  DETERMINE TO BE USED FOR THE PURPOSE OF PROMOTING WILDLIFE
    17  MANAGEMENT. SUCH MATERIALS MAY BE SOLD BY THE COMMISSION AT A
    18  FEE DETERMINED BY THEM OR GIVEN AWAY FREE OF CHARGE IN
    19  RECOGNITION OF PROMOTING THE CAUSE OF WILDLIFE MANAGEMENT.
    20     Section 3. 2.  This act shall take effect immediately.         <--
