                                  A SUPPLEMENT

     1  To the act of November 30, 1965 (P.L.843, No.355), entitled "An
     2     act providing for the establishment and operation of Temple
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related university in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; providing for public support and capital
    10     improvements; authorizing appropriations in amounts to be
    11     fixed annually by the General Assembly; providing for the
    12     auditing of accounts of expenditures from said
    13     appropriations; authorizing the issuance of bonds exempt from
    14     taxation within the Commonwealth; requiring the President to
    15     make an annual report of the operations of Temple
    16     University," making appropriations for carrying the same into
    17     effect, providing for a basis for payments of such
    18     appropriation and providing a method of accounting for the
    19     funds appropriated.

    20     The General Assembly of the Commonwealth of Pennsylvania
    21  hereby enacts as follows:
    22     Section 1.  The following sums, or as much thereof as may be
    23  necessary, are hereby specifically appropriated to the Trustees
    24  of Temple University at Philadelphia for the fiscal year July 1,
    25  1977 to June 30, 1978, for the purposes and in the amounts as
    26  shown:
    27     (1)  For educational and general expenses.....    $58,680,000

     1     (2)  For cost of student aid..................      3,018,000
     2     (3)  For instruction - Doctor of Medicine
     3          only.....................................      5,412,000
     4     (4)  For operation of dental clinics in the
     5          school of dentistry......................        500,000
     6     Section 2.  Payments to Temple University on account of the
     7  appropriations for all items, as provided in section 1, except
     8  for instruction Doctor of Medicine, shall be made on the basis
     9  of costs during the fiscal year.
    10     Payments for instruction - Doctor of Medicine only shall be
    11  made on the basis of full-time students enrolled at the rate of
    12  $7,465 per student.
    13     Section 3.  If necessary, Temple University may transfer
    14  funds among the appropriations listed in section 1, clauses (1)
    15  and (2): Provided, That the aggregate amount transferred into or
    16  out of each appropriation during the fiscal year shall not
    17  exceed 5% of the amount specifically appropriated for that
    18  purpose.
    19     Section 4.  Payment to Temple University of the
    20  appropriations herein provided shall be made monthly during the
    21  fiscal year.
    22     Such monthly payments shall be made in accordance with the
    23  provisions of sections 2 and 3, on the basis of estimated costs
    24  and full-time students enrolled in the Doctor of Medicine
    25  program. The estimate of costs shall be submitted by Temple
    26  University to the Secretary of Education, the General Assembly
    27  and to the State Treasurer not later than 30 days prior to the
    28  date on which such payment is to be made.
    29     Section 5.  Temple University shall apply the moneys
    30  appropriated by this act only for such purposes as are permitted

     1  in this act and shall at all times maintain proper records
     2  showing the application of such moneys. Not later than 120 days
     3  after the close of the fiscal year to which this act relates,
     4  Temple University shall file with the Secretary of Education,
     5  the General Assembly and with the Auditor General of the
     6  Commonwealth a statement setting forth the amounts and purposes
     7  of all expenditures made from moneys appropriated by this act
     8  and other university accounts during said fiscal year the number
     9  of full-time students enrolled in the Doctor of Medicine program
    10  and costs, as provided in section 2, used as a basis for receipt
    11  of any appropriation during said fiscal year. Such statement of
    12  expenditures, and number of full-time students enrolled in the
    13  Doctor of Medicine program and costs shall be reviewed by the
    14  Auditor General of the Commonwealth, and he shall have the
    15  right, in respect to the moneys appropriated by this act, to
    16  audit and disallow expenditures made for purposes not permitted
    17  by this act and to cause such sums to be recovered and paid by
    18  Temple University to the Treasurer of the Commonwealth. The
    19  Auditor General shall also make a determination of full-time
    20  students enrolled in the Doctor of Medicine program and costs
    21  and make certification as to their correctness. In respect to
    22  expenditures made by the university from moneys other than those
    23  appropriated by this act, the Auditor General shall have the
    24  right to review only and he shall file annually with the General
    25  Assembly such information concerning said expenditures as the
    26  General Assembly or any of its committees may require.
    27     Section 6.  A report shall be submitted to the Secretary of
    28  Education, the Governor, and the Appropriations and Education
    29  Committees of the Senate and House of Representatives and shall
    30  include data for all programs of the university except the

     1  Doctor of Medicine program. The report, to be submitted prior to
     2  October 1, 1977, shall cover the twelve-month period beginning
     3  July 1, 1976 and ending June 30, 1977.  The report shall
     4  include:
     5     (1)  For each term during the period, the following counts
     6  and distributions:
     7     (i)  The definitions and numbers of full-time faculty
     8  members, of part-time faculty members, of full-time graduate
     9  students, of part-time graduate students, of full-time
    10  undergraduate students, and of part-time undergraduate students.
    11     (ii)  A distribution of part-time faculty members by the
    12  percentage of full-time employment.
    13     (iii)  Definitions of course levels of instruction and the
    14  number of different courses scheduled by course level,
    15  distributed by the number of sections scheduled in each course
    16  and the sections distributed by the number of students enrolled
    17  in each section.
    18     (iv)  Number of terms scheduled and the dates thereof.
    19     (2)  For the twelve-month period, the following, distributed
    20  by student level: lower division undergraduate, upper division
    21  undergraduate, graduate, and first professional (excluding
    22  Doctor of Medicine) within HEGIS discipline division (as defined
    23  by "A Taxonomy of Instructional Programs in Higher Education,"
    24  U. S. Department of Health, Education, and Welfare, Office of
    25  Education, 1970):
    26     (i)  The number of equivalent full-time students (EFTS)
    27  taught.
    28     (A)  EFTS taught by HEGIS discipline will be determined from
    29  production student credit hours (student credit hours produced
    30  by an academic department, regardless of the student majors

     1  taking the courses).
     2     (B)  EFTS taught by student level within HEGIS discipline
     3  divisions will be determined by the level of the students taking
     4  the courses, regardless of the course level of instruction of
     5  the courses being taken.
     6     (ii)  Teaching salaries per equivalent full-time student.
     7     (A)  Teaching salaries will be distributed by student level
     8  based on course credits taught, with equal weight given to all
     9  course levels of instruction.
    10     (B)  In distributing teaching salaries, each thirty student
    11  credit hours of thesis or dissertation work equals one three-
    12  credit section.
    13     (C)  In distributing teaching salaries, all students engaged
    14  in independent study who are assigned to one faculty member will
    15  be considered one three-credit section.
    16     (D)  Teaching salaries will be distributed by student level
    17  only for those individuals budgeted for instruction as reflected
    18  in Part III, "Instruction and Departmental Research,"
    19  Commonwealth of Pennsylvania Budget Instructions for State-
    20  Related Universities, Phase I, Fiscal Year 1978-1979.
    21     (iii)  Total costs per equivalent full-time student.
    22     (A)  Direct costs other than teaching salaries will be
    23  allocated by student level within HEGIS discipline division
    24  based on institutional records.
    25     (B)  Indirect costs of instruction will be prorated to each
    26  student level within HEGIS discipline division as a percentage
    27  of direct costs. An exception will be major organized activities
    28  (e.g., university farm operations, dental clinics). These
    29  activities will be allocated directly to the related HEGIS
    30  discipline group.

     1     (iv)  Costs to the Commonwealth per equivalent full-time
     2  student.
     3     (A)  Total costs will be offset by income for instruction to
     4  determine costs to the Commonwealth.
     5     (B)  Income for instruction derived from student tuition will
     6  be allocated by HEGIS discipline and by student level based on
     7  the number of equivalent full-time students and the specific
     8  tuition rates for that level.
     9     (C)  Income for instruction derived from other sources and
    10  related to a specific HEGIS discipline group will be allocated
    11  directly to that group.
    12     (D)  Income for instruction derived from other sources and
    13  not related to a specific HEGIS discipline group will be
    14  allocated as a percentage of student tuition income.
    15     (v)  Totals by student level for all HEGIS discipline
    16  divisions combined for:
    17     (A)  The number of equivalent full-time students taught.
    18     (B)  Teaching salaries per equivalent full-time student.
    19     (C)  Total costs per equivalent full-time student.
    20     (D)  Costs to the Commonwealth per equivalent full-time
    21  student.
    22  These totals must agree with the corresponding totals in Part
    23  III, "Instruction and Departmental Research," Commonwealth of
    24  Pennsylvania Budget Instructions for State-Related Universities,
    25  Phase I, Fiscal Year 1978-1979.
    26     (vi)  All program data will be compiled from institutional
    27  records.  Program data are required for each HEGIS discipline in
    28  which the institution offers instructional programs (excluding
    29  Doctor of Medicine Program). Unless otherwise specifically
    30  stated, the conventions and procedures will be the same as those

     1  specified in the Commonwealth of Pennsylvania Budget
     2  Instructions for State-Related Universities, Phase I, Fiscal
     3  Year 1978-1979.
     4     Section 7.  In addition to the requirements of section 6, the
     5  report covering the twelve-month period beginning July 1, 1976
     6  and ending June 30, 1977, shall include for all programs of the
     7  university, except the Doctor of Medicine program:
     8     (1)  Minimum number of credits required for a baccalaureate
     9  degree, and for a master's degree.
    10     (2)  Number of associate degrees, baccalaureate degrees,
    11  master's degrees, first-professional degrees, and doctoral
    12  degrees awarded by HEGIS discipline divisions, for 1975-1976,
    13  1976-1977 and projected for 1977-1978.
    14     (3)  A listing of the academic departments and instructional
    15  subject matter in each of the HEGIS discipline divisions
    16  included in the report specified in section 6.
    17     Section 8.  The university shall provide such information and
    18  in such form and manner as the Department of Education may
    19  prescribe.
    20     Section 9.  The university shall report its revenues and
    21  expenditures and present its financial statements required under
    22  the provisions of this act in accordance with generally accepted
    23  accounting principles and procedures for educational
    24  institutions as set forth in "Higher Education Finance Manual"
    25  United States Department of Health, Education and Welfare (1975)
    26  with the exceptions set forth in the Commonwealth of
    27  Pennsylvania Budget Instructions for State Related Universities,
    28  Phase I, Fiscal Year 1977-1978. Credits granted for non-
    29  traditional programs such as CLEP, lifelong learning etc.,
    30  including all related costs and revenues thereof shall be

     1  excluded from the function of "Instruction" and included under
     2  "Public Service."
     3     Section 10.  This act shall take effect July 1, 1977.
