           REPRESENTATIVES, AS AMENDED, SEPTEMBER 26, 1977

                                  A SUPPLEMENT

     1  To the act of July 28, 1966 (3rd Sp.Sess., P.L.87, No.3),
     2     entitled "An act providing for the establishment and
     3     operation of the University of Pittsburgh as an
     4     instrumentality of the Commonwealth to serve as a State-
     5     related university in the higher education system of the
     6     Commonwealth; providing for change of name; providing for the
     7     composition of the board of trustees; terms of trustees, and
     8     the power and duties of such trustees; authorizing
     9     appropriations in amounts to be fixed annually by the General
    10     Assembly; providing for the auditing of accounts of
    11     expenditures from said appropriations; providing for public
    12     support and capital improvements; authorizing the issuance of
    13     bonds exempt from taxation within the Commonwealth; requiring
    14     the chancellor to make an annual report of the operations of
    15     the University of Pittsburgh," making appropriations for
    16     carrying the same into effect, providing for a basis for
    17     payments of such appropriations, and providing a method of
    18     accounting for the funds appropriated.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  The following sums, or as much thereof as may be
    22  necessary, are hereby specifically appropriated to the Trustees
    23  of the University of Pittsburgh for the fiscal year July 1, 1977
    24  to June 30, 1978, for the purpose and in the amounts as shown:
    25     (1)  For educational and general expenses.....    $54,444,000  <--

     1     (2)  For cost of student aid..................      2,960,000
     2     (3)  For instruction - Doctor of Medicine
     3          only........................................   4,031,000
     4     (4)  For operation of dental clinics in the
     5          school of dentistry.........................     500,000  <--

     7     Section 2.  Payments to the University of Pittsburgh on
     8  account of the appropriations for all items, as provided in
     9  section 1 except for instruction - Doctor of Medicine shall be
    10  made on the basis of costs during the fiscal year.
    11     Payments for instruction - Doctor of Medicine shall be made
    12  on the basis of full-time student enrollment at the rate of
    13  $7,465 per student.
    14     Section 3.  If necessary the University of Pittsburgh may
    15  transfer funds between the appropriations listed in section 1,
    16  clauses (1) and (2): Provided, That the aggregate amount
    17  transferred into or out of each appropriation during the fiscal
    18  year shall not exceed 5% of the amount specifically appropriated
    19  for that purpose.
    20     Section 4.  Payments to the University of Pittsburgh of the
    21  appropriations herein provided shall be made monthly during the
    22  fiscal year.
    23     Such monthly payments shall be made in accordance with the
    24  provisions of section 2 on the basis of estimated costs and
    25  full-time students enrolled in the Doctor of Medicine program.
    26  The estimate of costs shall be submitted by the University of
    27  Pittsburgh to the Secretary of Education, the General Assembly
    28  and to the Treasurer of the Commonwealth not later than 30 days
    29  prior to the date on which such payment is to be made.
    30     Section 5.  The University of Pittsburgh shall apply the

     1  moneys appropriated by this act only for such purposes as are
     2  permitted in this act and shall at all times maintain proper
     3  records showing the application of such moneys. Not later than
     4  120 days after the close of the fiscal year to which this act
     5  relates, the University of Pittsburgh shall file with the
     6  Secretary of Education, the General Assembly and with the
     7  Auditor General of the Commonwealth, a statement setting forth
     8  the amounts and purposes of all expenditures made from moneys
     9  appropriated by this act and other university accounts during
    10  said fiscal year, the number of full-time students enrolled in
    11  the Doctor of Medicine program and costs, as provided in section
    12  2, used as a basis for receipt of any appropriation during said
    13  fiscal year.
    14     Such statement of expenditures, and number of full-time
    15  students enrolled in the Doctor of Medicine program and costs
    16  shall be reviewed by the Auditor General of the Commonwealth,
    17  and he shall have the right, in respect to the moneys
    18  appropriated by this act, to audit and disallow expenditures
    19  made for purposes not permitted by this act and to cause such
    20  sums to be recovered and paid by the University of Pittsburgh to
    21  the Treasurer of the Commonwealth. The Auditor General shall
    22  also make a determination of full-time students enrolled in the
    23  Doctor of Medicine program and costs and make a certification as
    24  to their correctness. In respect to expenditures made by the
    25  university from moneys other than those appropriated by this
    26  act, the Auditor General shall have the right to review only and
    27  he shall file annually with the General Assembly such
    28  information concerning such expenditures as the General Assembly
    29  or any of its committees may require.
    30     Section 6.  A report shall be submitted to the Secretary of    <--

     1  Education, the Governor and the Appropriations and Education
     2  Committees of the Senate and House of Representatives and shall
     3  include data for all programs of the university except the
     4  Doctor of Medicine program. The report, to be submitted prior to
     5  October 1, 1977, shall cover the twelve-month period beginning
     6  July 1, 1976 and ending June 30, 1977.  The report shall
     7  include:
     8     (1)  For each term during the period, the following counts
     9  and distributions:
    10     (i)  The definitions and numbers of full-time faculty
    11  members, of part-time faculty members, of full-time graduate
    12  students, of part-time graduate students, of full-time
    13  undergraduate students, and of part-time undergraduate students.
    14     (ii)  A distribution of part-time faculty members by the
    15  percentage of full-time employment.
    16     (iii)  Definitions of course levels of instruction and the
    17  number of different courses scheduled by course level,
    18  distributed by the number of sections scheduled in each course
    19  and the sections distributed by the number of students enrolled
    20  in each section.
    21     (iv)  Number of terms scheduled and the dates thereof.
    22     (2)  For the twelve-month period, the following, distributed
    23  by student level: lower division undergraduate, upper division
    24  undergraduate, graduate, and first professional (excluding
    25  Doctor of Medicine) within HEGIS discipline division (as defined
    26  by "A Taxonomy of Instructional Programs in Higher Education,"
    27  U. S. Department of Health, Education, and Welfare, Office of
    28  Education, 1970):
    29     (i)  The number of equivalent full-time students (EFTS)
    30  taught.

     1     (A)  EFTS taught by HEGIS discipline will be determined from
     2  production student credit hours (student credit hours produced
     3  by an academic department, regardless of the student majors
     4  taking the courses).
     5     (B)  EFTS taught by student level within HEGIS discipline
     6  divisions will be determined by the level of the students taking
     7  the courses, regardless of the course level of instruction of
     8  the courses being taken.
     9     (ii)  Teaching salaries per equivalent full-time student.
    10     (A)  Teaching salaries will be distributed by student level
    11  based on course credits taught, with equal weight given to all
    12  course levels of instruction.
    13     (B)  In distributing teaching salaries, each thirty student
    14  credit hours of thesis or dissertation work equals one three-
    15  credit section.
    16     (C)  In distributing teaching salaries, all students engaged
    17  in independent study who are assigned to one faculty member will
    18  be considered one three-credit section.
    19     (D)  Teaching salaries will be distributed by student level
    20  only for those individuals budgeted for instruction as reflected
    21  in Part III, "Instruction and Departmental Research,"
    22  Commonwealth of Pennsylvania Budget Instructions for State-
    23  Related Universities, Phase I, Fiscal Year 1978-1979.
    24     (iii)  Total costs per equivalent full-time student.
    25     (A)  Direct costs other than teaching salaries will be
    26  allocated by student level within HEGIS discipline division
    27  based on institutional records.
    28     (B)  Indirect costs of instruction will be prorated to each
    29  student level within HEGIS discipline division as a percentage
    30  of direct costs. An exception will be major organized activities

     1  (e.g., university farm operation, dental clinics). These
     2  activities will be allocated directly to the related HEGIS
     3  discipline group.
     4     (iv)  Costs to the Commonwealth per equivalent full-time
     5  student.
     6     (A)  Total costs will be offset by income for instruction to
     7  determine costs to the Commonwealth.
     8     (B)  Income for instruction derived from student tuition will
     9  be allocated by HEGIS discipline and by student level based on
    10  the number of equivalent full-time students and the specific
    11  tuition rates for that level.
    12     (C)  Income for instruction derived from other sources and
    13  related to a specific HEGIS discipline group will be allocated
    14  directly to that group.
    15     (D)  Income for instruction derived from other sources and
    16  not related to a specific HEGIS discipline group will be
    17  allocated as a percentage of student tuition income.
    18     (v)  Totals by student level for all HEGIS discipline
    19  divisions combined for:
    20     (A)  The number of equivalent full-time students taught.
    21     (B)  Teaching salaries per equivalent full-time student.
    22     (C)  Total costs per equivalent full-time student.
    23     (D)  Costs to the Commonwealth per equivalent full-time
    24  student.
    25  These totals must agree with the corresponding totals in Part
    26  III, "Instruction and Departmental Research," Commonwealth of
    27  Pennsylvania Budget Instructions for State-Related Universities,
    28  Phase I Fiscal Year 1978-1979.
    29     (vi)  All program data will be compiled from institutional
    30  records.  Program data are required for each HEGIS discipline in

     1  which the institution offers instructional programs (excluding
     2  Doctor of Medicine Program). Unless otherwise specifically
     3  stated, the conventions and procedures will be the same as those
     4  specified in the Commonwealth of Pennsylvania Budget
     5  Instructions for State-Related Universities, Phase I, Fiscal
     6  Year 1978-1979.
     7     Section 7.  In addition to the requirements of section 6, the
     8  report covering the twelve-month period beginning July 1, 1976
     9  and ending June 30, 1977, shall include for all programs of the
    10  university, except the Doctor of Medicine program:
    11     (1)  Minimum number of credits required for a baccalaureate
    12  degree, and for a master's degree.
    13     (2)  Number of associate degrees, baccalaureate degrees,
    14  master's degrees, first-professional degrees, and doctoral
    15  degrees awarded by HEGIS discipline divisions, for 1975-1976,
    16  1976-1977 and projected for 1977-1978.
    17     (3)  A listing of the academic departments and instructional
    18  subject matter in each of the HEGIS discipline divisions
    19  included in the report specified in section 6.
    20     SECTION 6.  A REPORT SHALL BE SUBMITTED TO THE GOVERNOR AND    <--
    21  THE APPROPRIATIONS AND EDUCATION COMMITTEES OF THE SENATE AND
    22  HOUSE OF REPRESENTATIVES AND SHALL INCLUDE DATA FOR ALL PROGRAMS
    23  EXCEPT THE DOCTOR OF MEDICINE PROGRAM. EACH SUCH REPORT, TO BE
    24  SUBMITTED PRIOR TO NOVEMBER 1, 1978, SHALL COVER THE 12-MONTH
    25  PERIOD BEGINNING SEPTEMBER 1, 1977 AND SHALL INCLUDE FOR EACH
    26  TERM DURING THE PERIOD:
    27         (1)  THE FOLLOWING COUNTS AND DISTRIBUTIONS:
    28             (I)  THE DEFINITIONS AND NUMBERS OF FULL-TIME FACULTY
    29         MEMBERS, OF PART-TIME FACULTY MEMBERS, OF FULL-TIME
    30         STUDENTS ENROLLED IN GRADUATE COURSES, OF FULL-TIME

     1         STUDENTS ENROLLED IN UNDERGRADUATE COURSES, OF PART-TIME
     2         STUDENTS ENROLLED IN GRADUATE COURSES, AND OF PART-TIME
     3         STUDENTS ENROLLED IN UNDERGRADUATE COURSES.
     4             (II)  A DISTRIBUTION OF PART-TIME FACULTY MEMBERS BY
     5         THE PERCENTAGE OF FULL-TIME EMPLOYMENT.
     6             (III)  TOTAL NUMBERS OF UNDERGRADUATE STUDENT CREDIT
     7         HOURS, DIVIDED INTO LOWER DIVISION AND UPPER DIVISION
     8         LEVELS, AND OF GRADUATE STUDENT CREDIT HOURS DIVIDED INTO
     9         THREE LEVELS--MASTER'S, FIRST PROFESSIONAL AND DOCTORAL.
    10             (IV)  NUMBER OF DIFFERENT COURSES SCHEDULED BY LEVEL
    11         OF INSTRUCTION, DISTRIBUTED BY THE NUMBER OF SECTIONS
    12         SCHEDULED IN EACH COURSE AND THE SECTIONS DISTRIBUTED BY
    13         THE NUMBER OF STUDENTS ENROLLED IN EACH SECTION.
    14             (V)  NUMBER OF TERMS SCHEDULED AND THE DATES THEREOF.
    15         (2)  A CLASSIFICATION OF FACULTY MEMBERS OR OTHER
    16     PROFESSIONAL EMPLOYEES BY TITLE INCLUDING: PROFESSOR,
    17     ASSOCIATE PROFESSOR, ASSISTANT PROFESSOR, INSTRUCTOR,
    18     LECTURER, RESEARCH ASSOCIATE, LIBRARIAN, AND ACADEMIC
    19     ADMINISTRATOR; FACULTY MEMBERS OR OTHER PROFESSIONAL
    20     EMPLOYEES UNDER EACH TITLE TO BE SUBDIVIDED BY TYPE OF
    21     ASSIGNMENT: UNDERGRADUATE COURSES ONLY, GRADUATE COURSES
    22     ONLY, OR BOTH GRADUATE AND UNDERGRADUATE COURSES; AND EACH
    23     SUCH SET OF FACULTY MEMBERS OR OTHER PROFESSIONAL EMPLOYEES

     7             (IV)  TOTAL SALARY PAID.
     8             (V)  TOTAL SALARY PAID FROM COLLEGE OR UNIVERSITY
     9         FUNDS.
    10             (VI)  TOTAL SALARY PAID FROM FEDERAL FUNDS.
    11             (VII)  TOTAL SALARY PAID FROM OTHER FUNDS.
    12         (3)  FOR EACH TERM OF THE PERIOD COVERED FOR EACH FULL-
    13     TIME FACULTY MEMBER IDENTIFIED BY SCHOOL, DEPARTMENT AND
    14     TITLE:
    15             (I)  AN ANALYSIS OF THE AVERAGE HOURS PER WEEK SPENT
    16         IN COLLEGE OR UNIVERSITY-RELATED ACTIVITIES, STATING
    17         SPECIFICALLY HOURS SPENT IN UNDERGRADUATE CLASSROOM
    18         CONTACT AND GRADUATE CLASSROOM CONTACT, HOURS SPENT IN
    19         PREPARATION, HOURS SPENT IN RESEARCH AND HOURS SPENT IN

    23     IN ADDITION TO THE ABOVE REQUIREMENTS RELATIVE TO THIS
    24  APPROPRIATION, EACH REPORT COVERING THE 12-MONTH PERIOD
    25  BEGINNING SEPTEMBER 1, 1977, SHALL INCLUDE FOR ALL PROGRAMS OF
    26  THE STATE COLLEGES OR STATE-OWNED UNIVERSITY:
    27         (1)  MINIMUM NUMBER OF CREDITS REQUIRED FOR A
    28     BACCALAUREATE DEGREE AND FOR A MASTER'S DEGREE.
    29         (2)  NUMBER OF BACHELOR'S DEGREES, MASTER'S DEGREES,
    30     FIRST PROFESSIONAL DEGREES, AND DOCTORAL DEGREES AWARDED IN

     1     1975, 1976, 1977 AND ESTIMATED 1978.
     2     THE STATE COLLEGES AND STATE-OWNED UNIVERSITY SHALL REPORT
     3  THEIR REVENUES AND EXPENDITURES AND PRESENT THEIR FINANCIAL
     4  STATEMENTS REQUIRED UNDER THE PROVISIONS OF THIS ACT IN
     5  ACCORDANCE WITH HIGHER EDUCATION FINANCE MANUAL (1975).
     6     Section 8. 7.  The university shall provide such information   <--
     7  and in such form and manner as the Department of Education may
     8  prescribe.
     9     Section 9. 8.  The university shall report its revenues and    <--
    10  expenditures and present its financial statements required under
    11  the provisions of this act in accordance with generally accepted
    12  accounting principles and procedures for educational
    13  institutions as set forth in "Higher Education Finance Manual"
    14  United States Department of Health, Education and Welfare (1975)
    15  with the exceptions set forth in the Commonwealth of
    16  Pennsylvania Budget I Instructions for State Related
    17  Universities, Phase I, Fiscal Year 1977-1978. Credits granted
    18  for non-traditional programs such as CLEP, lifelong learning
    19  etc., including all related costs and revenues thereof shall be
    20  excluded from the function of "Instruction" and included under
    21  "Public Service."
    22     Section 10. 9.  This act shall take effect July 1, 1977.       <--
