AN ACT
1 Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
2 as amended, "An act relating to counties of the second class
3 and second class A; amending, revising, consolidating and
4 changing the laws relating thereto," operating the power to
5 procure Pennsylvania National Guard equipment for use by
6 counties in times of declared emergency.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of July 28, 1953 (P.L.723, No.230), known
10 as the "Second Class County Code," is amended by adding a
11 section to read:
12 Section 2104.--Use of National Guard Equipment in
13 Emergencies.--(a) The commissioners of each county shall have
14 the power in times of declared emergencies, as specified by the
15 Governor, to procure and utilize equipment normally under the
16 jurisdiction and purview of the Pennsylvania National Guard.
17 (b) Neither the county commissioners nor their agents shall
18 be held liable for any actions resultant of this utilization but
19 they shall nevertheless be responsible for injury to this
1 equipment.
2 Section 2. This act shall take effect in 60 days.
