                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," removing the requirement that certain properties be
     5     connected with sewer systems constructed by municipal
     6     authorities in second class townships.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1501.1, act of May 1, 1933 (P.L.103,
    10  No.69), known as "The Second Class Township Code," added January
    11  14, 1952 (1951 P.L.1989, No.555), is amended to read:
    12     Section 1501.1.  Sewer System Established or Constructed by
    13  Municipal Authorities; Connection and Use by Owners;
    14  Enforcement.--Whenever a sewer system is or shall have been
    15  established or constructed by a municipality authority within a
    16  township of the second class, the township supervisors shall be
    17  empowered, by ordinance, to compel all owners of property
    18  accessible to and whose principal building is within one hundred
    19  fifty feet from such sewer system to make connection therewith
    20  and use such sewer system in such manner as they may order

     1  whenever the sewer system on such property does not meet the
     2  standards of the act of January 24, 1966 (1965 P.L.1535,
     3  No.537), known as the "Pennsylvania Sewage Facilities Act." The
     4  township supervisors may, by ordinance, impose penalties to
     5  enforce any regulation or order they may ordain with reference
     6  to any sewer connections. In case any owner of property
     7  accessible to and whose principal building is within one hundred
     8  fifty feet from a sewer system established or constructed by a
     9  municipality authority shall neglect or refuse to connect with
    10  said sewer system in violation of this section for a period of
    11  sixty days after notice to do so has been served upon him by the
    12  township supervisors, either by personal service or by
    13  registered mail, the township supervisors or their agents may
    14  enter upon such property and construct such connection. In such
    15  case, the township supervisors shall forthwith, upon completion
    16  of the work, send an itemized bill of the cost of the
    17  construction of such connection to the owner of the property to
    18  which connection has been so made, which bill shall be payable
    19  forthwith. In case of neglect or refusal by the owner of such
    20  property to pay said bill, it shall be the duty of the township
    21  supervisors to file municipal liens for said construction within
    22  six months of the date of the completion of the construction of
    23  said connection, the same to be subject in all respects to the
    24  general law provided for the filing and recovery of municipal
    25  liens.
    26     Section 2.  This act shall take effect immediately.
