                                     AN ACT

     1  Amending the act of March 23, 1972 (P.L.136, No.52), entitled
     2     "An act relating to the practice of psychology, providing for
     3     licensing of psychologists, making certain acts illegal and
     4     providing penalties," adding a member of the public at large
     5     to the board.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 4, act of March 23, 1972 (P.L.136,
     9  No.52), referred to as the Psychologists License Act is amended
    10  to read:
    11     Section 4.  There is hereby created the Pennsylvania Board of
    12  Psychologist Examiners as follows:
    13     (1)  Said board shall consist of [seven] eight members who
    14  are citizens of the United States, residents of the Commonwealth
    15  of Pennsylvania for a three-year period, [six] seven of whom are
    16  to be appointed by the Governor with the advice and consent of
    17  two-thirds of all the members of the Senate within ninety days
    18  from the effective date of this act and the commissioner shall
    19  serve, ex officio, as the seventh member of the board. At the
    20  first meeting the appointed members shall determine by lot two

     1  members to serve three-year terms, two members to serve two-year
     2  terms and two members to serve one-year terms.
     3     (2)  When the term of each member of the board ends, the
     4  Governor shall appoint his successor for a term of three years.
     5  Any vacancy occurring on the board shall be filled by the
     6  Governor by appointment for the unexpired term. Board members
     7  shall continue to serve until their successors are appointed.
     8     (3)  The board shall have at least two members who, at the
     9  time of appointment are engaged primarily in rendering
    10  professional services in psychology and at least two members who
    11  at the time of appointment are engaged in research in psychology
    12  or the teaching of psychology, one of whom shall be from a
    13  university granting doctoral degrees in psychology, all of whom
    14  shall be eligible for licensing under this act. One member of
    15  the board shall be appointed by the Governor from nominations of
    16  members of the office of mental health and mental retardation
    17  submitted by the commissioners. One member of the board shall be
    18  appointed by the Governor from nominations of mental health and
    19  mental retardation advocacy groups submitted by their boards of
    20  directors. One member of the board shall be appointed by the
    21  Governor to represent the public at large.
    22     (4)  No board member shall serve more than two consecutive
    23  terms.
    24     (5)  Each board member shall receive actual necessary
    25  traveling expenses incidental to board meetings, plus per diem
    26  expenses as approved by the commissioner upon recommendation of
    27  the board.
    28     (6)  The board shall within one hundred fifty days after the
    29  effective date of this act, and annually thereafter in the month
    30  prescribed by the board, hold a meeting, and elect a chairman

     1  and vice-chairman. The board shall meet at such other times as
     2  deemed necessary and advisable by the chairman, or by a majority
     3  of its members. Reasonable notice of all meetings shall be given
     4  in the manner prescribed by the board. A majority of the board
     5  shall constitute a quorum at any meeting or hearing.
     6     Section 2.  This act shall take effect in 60 days.
