                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for maximum sentences for
     3     certain felons.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1103 of Title 18, act of November 25,
     7  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     8  Statutes, is amended to read:
     9  § 1103.  Sentence of imprisonment for felony.
    10     (a)  General rule.--A person who has been convicted of a
    11  felony may be sentenced to imprisonment as follows:
    12         (1)  In the case of a felony of the first degree, for a
    13     term which shall be fixed by the court at not more than 20
    14     years.
    15         (2)  In the case of a felony of the second degree, for a
    16     term which shall be fixed by the court at not more than ten
    17     years.
    18         (3)  In the case of a felony of the third degree, for a


     1  term which shall be fixed by the court at not more than seven
     2  years.
     3     (b)  Subsequent offenses.--Whoever, after having been
     4  convicted of a second or subsequent felony, within or without
     5  this Commonwealth, within five years after the prior offense
     6  shall be sentenced to imprisonment for the maximum term as
     7  provided for in subsection (a).
     8     (c)  Computation of time.--In computing the period of time
     9  between convictions, as provided in subsection (b), any period
    10  of servitude by a person in a penal institution, within or
    11  without this Commonwealth, shall not be included in the
    12  computation of any of said five-year periods. The five-year
    13  periods shall run only during the time any such person shall be
    14  at liberty.
    15     Section 2.  This act shall take effect in 60 days.
