                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, removing the bonding requirement for messenger
     3     services.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Sections 7502(c) and 7503(a) of Title 75, act of
     7  November 25, 1970 (P.L.707, No.230), known as the Pennsylvania
     8  Consolidated Statutes, added June 17, 1976 (No.81), are amended
     9  to read:
    10  § 7502.  Certificate of authorization.

    12     (c)  Bond not required.--[Before issuing a certificate of
    13  authorization, the department shall require the applicant to
    14  furnish and maintain a bond indemnifying the public and the
    15  department in the amount of $50,000. An individual bond for each
    16  place of business is not required, but all places of business
    17  shall be covered by the bond.] The department shall not require
    18  any applicant to furnish any bond protection.

     2  § 7503.  Suspension of authorization.
     3     (a)  General rule.--The department shall supervise messenger
     4  services and, after providing an opportunity for a hearing,
     5  shall suspend the authorization of any messenger service which
     6  it finds is not properly operated or which has violated or
     7  failed to comply with any of the provisions of this chapter or
     8  regulations adopted by the department. Any suspended certificate
     9  of authorization shall be returned to the department
    10  immediately. A suspended certificate may be restored on such
    11  terms and conditions, [including the posting of additional
    12  bond,] as the department shall deem advisable. The department
    13  shall not require any bond protection.

    15     Section 2.  This act shall take effect immediately or July 1,
    16  1977, whichever is later.
