        AS RE-REPORTED FROM COMMITTEE ON GAME AND FISHERIES, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 26, 1977

                                     AN ACT

     1  Amending the act of December 15, 1959 (P.L.1779, No.673),
     2     entitled, as amended, "An act relating to fish, frogs,
     3     tadpoles and turtles; and amending, revising and
     4     consolidating and changing the law relating to fish in the
     5     inland waters and the boundary lakes and boundary rivers of
     6     the Commonwealth," changing the minimal age for which a        <--
     7     resident and nonresident fishing license is required and
     8     FURTHER PROVIDING FOR RESIDENT FISHING LICENSES FOR PERSONS    <--
     9     SIXTY-FIVE YEARS OF AGE AND OLDER AND changing the license
    10     fees.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Subsection (a) of section 220, act of December
    14  15, 1959 (P.L.1779, No.673), known as "The Fish Law of 1959,"
    15  amended July 24, 1973 (P.L.196, No.47), is amended to read:
    16     Section 220.  Resident Fishing License; Fees.--(a)  For the
    17  purposes of this article, every person sixteen years of age and
    18  upward, upon application to any issuing agent within the
    19  Commonwealth, or to the Commission, and upon the establishment
    20  of his identity and age to the satisfaction of the issuing agent
    21  or the Commission by producing a [bank book, letters, lodge

     1  cards, police cards, a] motor vehicle operator's permit or some
     2  other positive means of identification and age, that he [has
     3  been] IS a bona fide resident of this Commonwealth [for a period  <--
     4  of sixty days next preceding his application and was born in the
     5  United States, and in the case of naturalized foreign-born
     6  residents, the production of such applicant's naturalization
     7  papers,] or a member of the Armed Forces of the United States
     8  who is on full-time active duty and permanently assigned to a
     9  military installation located within the Commonwealth, shall,
    10  upon the payment to the issuing agent or the Commission of a
    11  license fee of [seven dollars fifty cents ($7.50)] nine dollars
    12  ($9.00) except as hereinafter provided for persons sixty-five
    13  years of age and over for the use of the Commonwealth, and in
    14  the event that the license is issued by an issuing agent, a fee
    15  of twenty-five cents (25¢) for the use of the issuing agent, be
    16  entitled to the license herein referred to as a "resident
    17  fishing license." Residents with the above qualifications, who
    18  are sixty-five or more years of age at the time of application,
    19  shall be entitled to a "senior resident fishing license" upon
    20  payment to said agent or the Commission of a license fee of two
    21  dollars ($2.00) for the use of the Commonwealth, and in the
    22  event that the license is issued by an issuing agent, a fee of
    23  twenty-five cents (25¢) for the use of the issuing agent. The
    24  license in such cases shall, in addition to the other
    25  information required, give the date of birth of the applicant.
    26  ANY PERSON WHO QUALIFIES TO PURCHASE A SENIOR RESIDENT LICENSE    <--
    27  MAY, IN LIEU THEREOF, PURCHASE A SENIOR RESIDENT LICENSE WHICH
    28  SHALL BE VALID FOR HIS LIFETIME UPON THE PAYMENT OF A FEE OF TEN
    29  DOLLARS ($10.00) FOR THE USE OF THE COMMONWEALTH, AND IN THE
    30  EVENT THE LICENSE IS ISSUED BY AN ISSUING AGENT, A FEE OF

     1  TWENTY-FIVE CENTS (25¢) FOR THE USE OF THE ISSUING AGENT.

     3     Section 2.  Section 220 of the act is amended by adding a      <--
     4  subsection to read:
     5     Section 220.  Resident Fishing License; Fees.--* * *
     6     (a.1)  For the purposes of this article every person who is
     7  fourteen years of age but who has not reached sixteen years of
     8  age, upon application to any issuing agent within the
     9  Commonwealth, or to the Commission, and upon the establishment
    10  of his identity and age to the satisfaction of the issuing agent
    11  or the Commission by some positive means of identification and
    12  age, that he is a bona fide resident of this Commonwealth, shall
    13  upon payment to the issuing agent or the Commission of a license
    14  fee of one dollar fifty cents ($1.50) for the use of the
    15  Commonwealth, and in the event that the license is issued by an
    16  issuing agent, a fee of twenty-five cents (25¢) for the use of
    17  the issuing agent, be entitled to the license herein referred to
    18  as a "junior fishing license."

    20     Section 3. 2.  The section heading and subsections (a) and     <--
    21  (b) of section 221 of the act, subsections (a) and (b) amended
    22  July 24, 1973 (P.L.196, No.47), are amended to read:
    23     Section 221.  Nonresident [and Alien Nonresident] Fishing
    24  License Fees; Tourist Fishing License Fees for Nonresidents [and
    25  Alien Nonresidents].--(a)  For the purposes of this article,
    26  every person, sixteen years of age and upward, upon application
    27  to any issuing agent within the Commonwealth or to the
    28  Commission [and the presentation of proof that he is an alien or
    29  a nonresident of this Commonwealth], shall, upon the payment to
    30  the issuing agent or the Commission of the sum of [twelve

     1  dollars fifty cents ($12.50)] fourteen dollars ($14.00), and in
     2  the event the license is issued by an issuing agent, the payment
     3  of twenty-five cents (25¢) for the use of the issuing agent, be
     4  entitled to the license herein referred to as a "nonresident
     5  fishing license." Nonresidents who are twelve years of age but    <--
     6  who have not reached sixteen years of age shall be entitled to a
     7  "junior fishing license" upon the payment to said issuing agent
     8  or to the Commission of a license fee of three dollars ($3.00)
     9  and in the event that the license is issued by an issuing agent,
    10  the payment of a fee of twenty-five cents (25¢) for the use of
    11  the agent.
    12     (b)  For the purposes of this article, every person, sixteen
    13  years of age and upward, upon application to any issuing agent
    14  within the Commonwealth, or to the Commission [and the
    15  presentation of proof that he is a nonresident of the
    16  Commonwealth], shall, upon the payment to the issuing agent or
    17  the Commission a license fee of [seven dollars fifty cents
    18  ($7.50)] nine dollars ($9.00) for the use of the Commonwealth,
    19  and in the event that the license is issued by an issuing agent,
    20  a fee of twenty-five cents (25¢) for the use of the issuing
    21  agent, be entitled to the license herein referred to as a
    22  "tourist fishing license," which shall be valid for a period of
    23  seven consecutive days.
    24     In case the license certificate is lost or destroyed, a new
    25  license may be secured from the Commission upon making affidavit
    26  to that effect and the payment of a fee of fifty cents (50¢).
