AN ACT 1 Amending the act of December 15, 1959 (P.L.1779, No.673), 2 entitled, as amended, "An act relating to fish, frogs, 3 tadpoles and turtles; and amending, revising and 4 consolidating and changing the law relating to fish in the 5 inland waters and the boundary lakes and boundary rivers of 6 the Commonwealth," changing the minimal age for which a 7 resident and nonresident fishing license is required and 8 changing the license fees. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Subsection (a) of section 220, act of December 12 15, 1959 (P.L.1779, No.673), known as "The Fish Law of 1959," 13 amended July 24, 1973 (P.L.196, No.47), is amended to read: 14 Section 220. Resident Fishing License; Fees.--(a) For the 15 purposes of this article, every person sixteen years of age and 16 upward, upon application to any issuing agent within the 17 Commonwealth, or to the Commission, and upon the establishment 18 of his identity and age to the satisfaction of the issuing agent 19 or the Commission by producing a [bank book, letters, lodge 20 cards, police cards, a] motor vehicle operator's permit or some
1 other positive means of identification and age, that he has been 2 a bona fide resident of this Commonwealth [for a period of sixty 3 days next preceding his application and was born in the United 4 States, and in the case of naturalized foreign-born residents, 5 the production of such applicant's naturalization papers,] or a 6 member of the Armed Forces of the United States who is on full- 7 time active duty and permanently assigned to a military 8 installation located within the Commonwealth shall, upon the 9 payment to the issuing agent or the Commission of a license fee 10 of [seven dollars fifty cents ($7.50)] nine dollars ($9.00) 11 except as hereinafter provided for persons sixty-five years of 12 age and over for the use of the Commonwealth, and in the event 13 that the license is issued by an issuing agent, a fee of twenty- 14 five cents (25¢) for the use of the issuing agent, be entitled 15 to the license herein referred to as a "resident fishing 16 license." Residents with the above qualifications, who are 17 sixty-five or more years of age at the time of application, 18 shall be entitled to a "senior resident fishing license" upon 19 payment to said agent or the Commission of a license fee of two 20 dollars ($2.00) for the use of the Commonwealth, and in the 21 event that the license is issued by an issuing agent, a fee of 22 twenty-five cents (25¢) for the use of the issuing agent. The 23 license in such cases shall, in addition to the other 24 information required, give the date of birth of the applicant. 25 Section 2. Section 220 of the act is amended by adding a 26 subsection to read: 27 Section 220. Resident Fishing License; Fees.--* * * 28 (a.1) For the purposes of this article every person who is 29 twelve FOURTEEN years of age but who has not reached sixteen <-- 30 years of age, upon application to any issuing agent within the 19770H0792B1304 - 2 -
1 Commonwealth, or to the Commission, and upon the establishment 2 of his identity and age to the satisfaction of the issuing agent 3 or the Commission by some positive means of identification and 4 age, that he is a bona fide resident of this Commonwealth, shall 5 upon payment to the issuing agent or the Commission of a license 6 fee of three dollars ($3.00) ONE DOLLAR FIFTY CENTS ($1.50) for <-- 7 the use of the Commonwealth, and in the event that the license 8 is issued by an issuing agent, a fee of twenty-five cents (25¢) 9 for the use of the issuing agent, be entitled to the license 10 herein referred to as a "junior fishing license." 11 * * * 12 Section 3. The section heading and subsections (a) and (b) 13 of section 221 of the act, subsections (a) and (b) amended July 14 24, 1973 (P.L.196, No.47), are amended to read: 15 Section 221. Nonresident [and Alien Nonresident] Fishing 16 License Fees; Tourist Fishing License Fees for Nonresidents [and 17 Alien Nonresidents].--(a) For the purposes of this article, 18 every person, sixteen years of age and upward, upon application 19 to any issuing agent within the Commonwealth or to the 20 Commission [and the presentation of proof that he is an alien or 21 a nonresident of this Commonwealth], shall, upon the payment to 22 the issuing agent or the Commission of the sum of [twelve 23 dollars fifty cents ($12.50)] fourteen dollars ($14.00), and in 24 the event the license is issued by an issuing agent, the payment 25 of twenty-five cents (25¢) for the use of the issuing agent, be 26 entitled to the license herein referred to as a "nonresident 27 fishing license." Nonresidents who are twelve years of age but 28 who have not reached sixteen years of age shall be entitled to a 29 "junior fishing license" upon the payment to said issuing agent 30 or to the Commission of a license fee of three dollars ($3.00) 19770H0792B1304 - 3 -
1 and in the event that the license is issued by an issuing agent, 2 the payment of a fee of twenty-five cents (25¢) for the use of 3 the agent. 4 (b) For the purposes of this article, every person, sixteen 5 years of age and upward, upon application to any issuing agent 6 within the Commonwealth, or to the Commission [and the 7 presentation of proof that he is a nonresident of the 8 Commonwealth], shall, upon the payment to the issuing agent or 9 the Commission a license fee of [seven dollars fifty cents 10 ($7.50)] nine dollars ($9.00) for the use of the Commonwealth, 11 and in the event that the license is issued by an issuing agent, 12 a fee of twenty-five cents (25¢) for the use of the issuing 13 agent, be entitled to the license herein referred to as a 14 "tourist fishing license," which shall be valid for a period of 15 seven consecutive days. 16 In case the license certificate is lost or destroyed, a new 17 license may be secured from the Commission upon making affidavit 18 to that effect and the payment of a fee of fifty cents (50¢). 19 * * * 20 Section 4.
