AN ACT 1 Amending the act of May 1, 1933 (P.L.216, No.76), entitled "An 2 act relating to dentistry; defining and providing for the 3 licensing and registration of dentists and dental hygienists, 4 and for the revocation and suspension of such licenses and 5 registrations, subject to appeal, and for their 6 reinstatement; defining the powers and duties of the State 7 Dental Council and Examining Board and the Department of 8 Public Instruction; providing penalties; and repealing 9 existing laws," increasing the powers of the board, 10 increasing certain fees and providing for the disposition of 11 the fee. 12 The General Assembly of the Commonwealth of Pennsylvania 13 hereby enacts as follows: 14 Section 1. Clause (c) of section 3, act of May 1, 1933 15 (P.L.216, No.76), known as "The Dental Law," is amended to read: 16 Section 3. General Powers of the State Dental Council and 17 Examining Board.--The State Dental Council and Examining Board 18 (hereinafter called the board), created, appointed, and 19 organized in accordance with the provisions of the 20 Administrative Code, and its amendments, shall have power: 21 * * * 22 (c) To provide for and to regulate the licensing, and to 23 license to practice dentistry, after examination, any duly
1 qualified applicant, at least twenty-one years of age, of good 2 moral character, not addicted to the use of intoxicating liquor 3 or narcotic drugs, who has obtained the required education, 4 together with a diploma from an approved institution or college 5 conferring upon him or her the degree of doctor of dental 6 surgery or other established dental degree; and to require, as 7 conditions for the retention of a license to practice dentistry 8 (i) enrollment in and successful completion of such remedial 9 education courses as shall be approved and prescribed by the 10 board for any licensee found by the board to be deficient in 11 professional skill, and (ii) successful passage of such 12 examination as shall be prescribed by the board. 13 * * * 14 Section 2. Section 4 of the act, amended December 15, 1959 15 (P.L.1753, No.656), is amended to read: 16 Section 4. Fees.--The fee for an applicant for examination 17 and licensure to practice dentistry or as a dental hygienist in 18 this Commonwealth shall be fixed by the Department of [Public 19 Instruction] Education in accordance with existing law. It shall 20 be the duty of all persons now qualified and engaged in the 21 practice of dentistry and dental hygiene, or who shall hereafter 22 be licensed by the board, to register biennially with said 23 board, and pay for each such biennial registration a fee which 24 shall be [ten dollars ($10)] twenty-five dollars ($25) for 25 persons engaged in the practice of dentistry and [four dollars 26 ($4)] ten dollars ($10) for persons engaged in the practice of 27 dental hygiene. 28 Section 3. Section 7 of the act is amended to read: 29 Section 7. Collection and Payment Over of Fees.--All fees 30 collected under the provisions of this act shall be received by 19770H0644B0710 - 2 -
1 the Department of [Public Instruction,] Education and shall be 2 paid into a special fund of the State Treasury, through the 3 Department of Revenue, for the use of the [general fund of the 4 Commonwealth.] board in the exercise of its powers and duties as 5 provided in this act. 6 Section 4.
