AS AMENDED ON SECOND CONSIDERATION, IN SENATE, NOVEMBER 21, 1977
AN ACT 1 Requiring advice of the need of a cytology (Papanicolaou) test 2 for uterine cancer detection of certain women receiving 3 hospital care, for the purpose of detecting uterine cancer 4 early and reducing the morbidity and mortality therefrom. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Any female 18 years of age or older who is 8 accepted for any reason, either as an inpatient or outpatient, <-- 9 in any hospital or clinic defined as such by the Commonwealth 10 shall be advised, UNLESS HER MEDICAL CONDITION INDICATES <-- 11 OTHERWISE, of the purpose of and the availability of tests for 12 the detection of uterine cancer, of an appropriate cytology test 13 of the Papanicolaou type, to be examined and reported upon by an 14 appropriate, qualified cytologist in a laboratory approved by 15 the Department of Health. UNLESS ONE OR MORE OF THE FOLLOWING <-- 16 SITUATIONS EXIST: 17 (1) THE PROCEDURE IS CONTRAINDICATED BECAUSE OF THE 18 MEDICAL CONDITION OF THE PATIENT.
1 (2) THE PROCEDURE IS REFUSED BY THE PATIENT. 2 (3) SCREENING UTERINE CYTOLOGY HAS BEEN OBTAINED IN THE 3 PREVIOUS 12 MONTHS AND FOUND TO BE NORMAL. 4 (4) A CONTRADICTORY ORDER IS WRITTEN BY A RESPONSIBLE 5 PHYSICIAN ON THE ORDER SHEET IN THE CHART. IN ADDITION, SHE 6 SHALL BE ADVISED THAT: 7 (1) SHE MAY REFUSE THE PROCEDURE. 8 (2) A PHYSICIAN MAY DIRECT THAT THE TEST NOT BE GIVEN 9 BECAUSE HER MEDICAL CONDITION CONTRAINDICATES THE PROCEDURE. 10 (3) THE TEST IS NOT RECOMMENDED IF A SCREENING OF 11 UTERINE CYTOLOGY HAS BEEN OBTAINED IN THE PREVIOUS 12 MONTHS 12 WHICH HAS BEEN FOUND TO BE NORMAL. 13 Section 2. The Pennsylvania Department of Health is hereby <-- 14 authorized to prepare directives to hospitals and clinics to 15 include in the patient medical records a section indicating 16 whether advisement of the intent and availability of tests is 17 applicable, the date when such advice and information was 18 offered and the name or initials of the person offering such 19 advice and information. The attending physician shall be 20 responsible for insuring that this form is completed. 21 Section 3 2. This act shall take effect in 60 days. <-- L27L32JLW/19770H0274B2330 - 2 -
