AN ACT 1 Authorizing the Department of General Services with the approval 2 of the Department of Public Welfare and the Governor, to 3 convey to the County of Dauphin, 204 acres of land, more or 4 less, situated in Susquehanna Township, Dauphin County, 5 Commonwealth of Pennsylvania. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The Department of General Services, with the 9 approval of the Department of Public Welfare and the Governor, 10 is hereby authorized and directed on behalf of the Commonwealth 11 of Pennsylvania, to grant and convey to the County of Dauphin, 12 the following tract of land situated in the Township of 13 Susquehanna, County of Dauphin, and Commonwealth of 14 Pennsylvania, bounded and described as follows: 15 Beginning at a point in the centerline of Elmerton Avenue, 16 said point being situate south 82 degrees 30 minutes 57 seconds 17 east 50.00 feet from a railroad spike at the intersection of the 18 centerline of Elmerton Avenue and the centerline of Bamburger 19 Road, thence with Elmerton Avenue the following four courses:
1 (1) South 82 degrees 30 minutes 57 seconds east 1739.00 feet 2 to a railroad spike; 3 (2) North 84 degrees 13 minutes 41 seconds east 916.97 feet 4 to a railroad spike; 5 (3) South 78 degrees 39 minutes 46 seconds east 530.04 feet 6 to a railroad spike; 7 (4) North 86 degrees 26 minutes 30 seconds east 747.27 feet 8 to a railroad spike; 9 thence with lands of the Commonwealth of Pennsylvania acquired 10 for the use of the Pennsylvania Game Commission south 19 degrees 11 58 minutes 22 seconds east 956.37 feet to a steel I-beam; thence 12 with lands leased to the Pennsylvania Department of 13 Transportation north 88 degrees 12 minutes 31 seconds west 14 334.94 to a steel I-beam; thence by the same south 15 degrees 45 15 minutes 08 seconds west 471.38 feet to a copper pin at lands now 16 or late of Roy A. Hollinger; thence with lands of said Hollinger 17 and lands of M. L. Lester north 78 degrees 39 minutes 30 seconds 18 west 1770.27 feet to a point; thence with lands of M. L. 1 221. 2 Being the same parcel or parcels as described in a survey 3 dated June 1, 1976 by Edward J. Prall, Registered Surveyor. 4 The conveyance shall be made under and subject to all other 5 easements, servitudes and rights of others, including but not 6 confined to streets, roadways, and rights of any telephone, 7 telegraph, water, electric, sewer, gas or pipeline companies, as 8 well as under and subject to any interests, estates or tenancies 9 vested in third persons whether or not appearing of record, for 10 any portion of the land or improvements erected thereon. 11 Section 2. The deed of conveyance shall contain a clause 12 that the lands conveyed shall be used for public park, 13 recreation and conservation purposes by the County of Dauphin 14 and if at any time the said County of Dauphin or its successor 15 in function conveys said property or authorizes or permits said 16 property to be used for any purpose other than public recreation 17 and parks purposes, the title thereto shall immediately revert 18 to and revest in the Commonwealth of Pennsylvania. 19 Section 3. The deed of conveyance shall be approved by the 20 Department of Justice and shall be executed by the Secretary of 21 the Department of General Services in the name of the 22 Commonwealth of Pennsylvania, with the approval of the Secretary 23 of Public Welfare and the Governor. 24 Section 4.
