                                     AN ACT

     1  Authorizing the Department of General Services with the approval
     2     of the Department of Public Welfare and the Governor, to
     3     convey to the County of Dauphin, 204 acres of land, more or
     4     less, situated in Susquehanna Township, Dauphin County,
     5     Commonwealth of Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Department of Public Welfare and the Governor,
    10  is hereby authorized and directed on behalf of the Commonwealth
    11  of Pennsylvania, to grant and convey to the County of Dauphin,
    12  the following tract of land situated in the Township of
    13  Susquehanna, County of Dauphin, and Commonwealth of
    14  Pennsylvania, bounded and described as follows:
    15     Beginning at a point in the centerline of Elmerton Avenue,
    16  said point being situate south 82 degrees 30 minutes 57 seconds
    17  east 50.00 feet from a railroad spike at the intersection of the
    18  centerline of Elmerton Avenue and the centerline of Bamburger
    19  Road, thence with Elmerton Avenue the following four courses:


     1     (1)  South 82 degrees 30 minutes 57 seconds east 1739.00 feet
     2  to a railroad spike;
     3     (2)  North 84 degrees 13 minutes 41 seconds east 916.97 feet
     4  to a railroad spike;
     5     (3)  South 78 degrees 39 minutes 46 seconds east 530.04 feet
     6  to a railroad spike;
     7     (4)  North 86 degrees 26 minutes 30 seconds east 747.27 feet
     8  to a railroad spike;
     9  thence with lands of the Commonwealth of Pennsylvania acquired
    10  for the use of the Pennsylvania Game Commission south 19 degrees
    11  58 minutes 22 seconds east 956.37 feet to a steel I-beam; thence
    12  with lands leased to the Pennsylvania Department of
    13  Transportation north 88 degrees 12 minutes 31 seconds west
    14  334.94 to a steel I-beam; thence by the same south 15 degrees 45
    15  minutes 08 seconds west 471.38 feet to a copper pin at lands now
    16  or late of Roy A. Hollinger; thence with lands of said Hollinger
    17  and lands of M. L. Lester north 78 degrees 39 minutes 30 seconds
    18  west 1770.27 feet to a point; thence with lands of M. L. Lester
    19  south 17 degrees 35 minutes 30 seconds west 429.00 to a point;
    20  thence by the same south 78 degrees 24 minutes 30 seconds east
    21  229.90 feet to a point in the center of Locust Lane; thence with
    22  Locust Lane the following six courses:
    23     (1)  South 37 degrees 55 minutes 27 seconds west 114.38 feet
    24  to a point;
    25     (2)  South 30 degrees 33 minutes 46 seconds west 166.20 feet
    26  to a point;
    27     (3)  South 61 degrees 48 minutes 24 seconds east 70.50 feet
    28  to a point;
    29     (4)  South 11 degrees 18 minutes 39 seconds west 157.01 feet

     2  to a point;

     6  to a blazed oak tree; thence by lands of others south 70 degrees
     7  22 minutes 25 seconds west 1028.12 feet to a point; thence south
     8  68 degrees 39 minutes 25 seconds west 565.98 feet to a concrete
     9  monument; thence south 13 degrees 50 minutes 02 seconds west
    10  236.39 feet to an iron pin; thence north 89 degrees 44 minutes
    11  14 seconds east 239.82 feet to an iron pin at corner of lands of
    12  the Harrisburg School District; thence with lands of the latter,
    13  south 48 degrees 31 minutes 45 seconds west 1050.00 feet to an
    14  iron pin, thence with lands of the grantor herein the following
    15  eight courses:
    16     (1)  North 25 degrees 54 minutes 11 seconds west 847.71 feet
    17  to an iron pin;
    18     (2)  North 21 degrees 53 minutes 37 seconds east 1781.43 feet
    19  to an iron pin;
    20     (3)  South 82 degrees 12 minutes 14 seconds east 159.31 feet
    21  to an iron pin;
    22     (4)  North 33 degrees 49 minutes 02 seconds east 304.95 feet
    23  to an iron pin;
    24     (5)  South 82 degrees 12 minutes 14 seconds east 667.57 feet
    25  to an iron pin;
    26     (6)  North 07 degrees 47 minutes 47 seconds east 242.60 feet
    27  to an iron pin;
    28     (7)  North 82 degrees 12 minutes 14 seconds west 1071.11 feet
    29  to a point;
    30     (8)  North 03 degrees 20 minutes 14 seconds east 1380.43 to

     1  the place of beginning.
     2     Containing 209.58 acres be the same more or less.
     3     Subject to a sewer easement previously granted to the
     4  Susquehanna Township Authority and also an easement for a
     5  waterline previously granted to the Pennsylvania State Police
     6  and also a right-of-way ingress and egress easement, said right-
     7  of-way easement being of a width of 36 minutes and being the
     8  easement previously granted to the Pennsylvania Department of
     9  Transportation as access to the 10.587 acre parcel leased to the
    10  Pennsylvania Department of Transportation.
    11     Being composed of all or parts of the following tracts of
    12  land:

     2     Being the same parcel or parcels as described in a survey
     3  dated June 1, 1976 by Edward J. Prall, Registered Surveyor.
     4     The conveyance shall be made under and subject to all other
     5  easements, servitudes and rights of others, including but not
     6  confined to streets, roadways, and rights of any telephone,
     7  telegraph, water, electric, sewer, gas or pipeline companies, as
     8  well as under and subject to any interests, estates or tenancies
     9  vested in third persons whether or not appearing of record, for
    10  any portion of the land or improvements erected thereon.
    11     Section 2.  The deed of conveyance shall contain a clause
    12  that the lands conveyed shall be used for public park,
    13  recreation and conservation purposes by the County of Dauphin
    14  and if at any time the said County of Dauphin or its successor
    15  in function conveys said property or authorizes or permits said
    16  property to be used for any purpose other than public recreation
    17  and parks purposes, the title thereto shall immediately revert
    18  to and revest in the Commonwealth of Pennsylvania.
    19     Section 3.  The deed of conveyance shall be approved by the
    20  Department of Justice and shall be executed by the Secretary of
    21  the Department of General Services in the name of the
    22  Commonwealth of Pennsylvania, with the approval of the Secretary
    23  of Public Welfare and the Governor.
    24     Section 4.  This act shall take effect immediately.
